Williams, Director of Human Resources RE: A Resolution Approving a Settlement in the Amount of $70,108.90 Against Texas Municipal League Intergovernmental Risk Pool (TMLIRP) for Damages to Various City Properties and Contents as A Result of a Winter Storm (February 15, 2021) Nature of the request: On February 15, 2021, the City of Port Arthur experienced a winter ice storm,resulting in damages to City property and contents. Staff Analysis, Considerations: The City has property damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TMLIRP). TMLIRP has offered the City a settlement of $70,108.90, less the deductible of $5,000.00, making the final settlement $65,108.90. This amount is sufficient to cover estimated property damages for the various properties. If additional damages are discovered, TMLIRP may issue a supplemental payment. Recommendation: I recommend approval of Proposed Resolution No. 21958 authorizing the property damage settlement against TMLIRP for damage sustained to various properties and contents. TML has offered to settle the claim for $70,108.90, less the deductible of$5,000.00, making final settlement$65,108.90. This is considered a fair and reasonable settlement. Budget Considerations: The funds received will be deposited in the Insurance Proceeds Account#158-00-000-4744-00-00-000. "Remember,we are here to serve the Citizens of Port Arthur." P.R. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE SETTLEMENT OF A CLAIM IN THE AMOUNT OF $70,108.90 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP) AS A RESULT OF DAMAGES TO CITY PROPERTY AND CONTENTS DUE TO THE WINTER STORM (FEBRUARY 15, 2021) WHEREAS, on February 15, 2021 , the City of Port Arthur experienced a winter ice storm, resulting in damages to city property and contents; and, WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TMLIRP); and, WHEREAS, TMLIRP has offered to settle these claims in the amount of $70,108.90 less the physical damage deductible amount of $5,000, making the final settlement offer $65,108.90, which has been determined to be a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1 . That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute the settlement in the amount of $70,108.90 less the physical damage deductible amount of $5,000.00, making the final settlement offer $65,108.90 for the claim against Texas Municipal League Intergovernmental Risk Pool (TMLIRP). This amount is based on an estimated cost of related repairs; therefore, if additional flood-related costs are incurred, Texas Municipal League Intergovernmental Risk Pool (TMLIRP) may issue a supplemental payment.
