SUBJECT: Proposed Ordinance No. 5954
The City Council authorized the advertisement for bids for the sale of the property
located at 648 4`h Street (Lot 12 Block 151, City of Port Arthur) and the Port Arthur
Police Association, Inc., of Port Arthur, Texas was the highest bidder in the amount of
$2,000.
BACKGROUND
The Purchasing Division advertised in the Port Arthur News October 19, 2008 and
October 26, 2008 and bids were opened November 12, 2008. We received three (3)
responses as follows:

SUMMARY
The City Council authorized the advertisement for bids for the sale of the property
located at 648 4`h Street (Lot 12•Block 151, City of Port Arthur) the Port Arthur Police
Association, Inc., of Port Arthur, Texas was the highest bidder in the amount of $2,000.

ORDINANCE NO.
AN ORDINANCE FOR THE SALE OF
PROPERTY LOCATED AT 648 4`" STREET,
PORT ARTHUR, TEXAS
WHEREAS, it is deemed in the best interest of the citizens for Council to
authorize the sale of the property located at 648 4`h Street, Port Arthur, Texas
(Lot 12, Block 151, City of Port Arthur); and
WHEREAS, in accordance with Section 272.001 Texas Local Government
code, public notice was published on October 19, 2008 and October 26, 2008 in the
Port Arthur News, a newspaper of general circulation, inviting sealed bids for the sale of
such property; and
WHEREAS, the City opened bids on November 12, 2008 and received three.(3)
Bids; and
WHEREAS, the highest bidder was the Port Arthur Police Association, Inc., Port
Arthur, Texas in the amount of $2,000; and
WHEREAS, the City will sell the property in its "as is" wndition.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Council authorizes the City Manager to execute a
deed, attached hereto as Exhibit "A", and other instruments necessary
for the sale of property located at 648 4`h Street, (Lot 12, Block 151, City of Port Arthur ).
Section 3. That the City Council awards the bid for purchase of the property
located at 648 4`h Street (Lot 12, Block 151, City of Port Arthur) to highest bidder, the
Port Arthur Police Association, Inc., Port Arthur, Texas, in the amount of $2,000.
Section 4. That the deed shall be delivered once the $2,000 is paid in full to
the City, which shall be received within sixty (60) days.
Section 5. That a copy of the caption of this Ordinance be spread upon the
minutes of the City Council.

CONSIDERATION: Two Thousand Dollars & No/100
Properties (including any improvement): the legal description is
Lot 12 Block 151, City of Port Arthur
Reservations From and Exceptions to Conveyance and Warranty: This conveyance
is made expressly subject to all easements, rights-of--way; restrictions, covenants and
conditions and all exceptions, reservations, and conveyances of minerals and/or royalties,
oil and gas and/or mineral leases, affecting the above described property, and to all
zoning laws ordinances, rules and regulations of municipal and/or other governmental
authorities, but only to extent that same are in force and effect and relate to the above
described property. This conveyance is also made subject to all state and federal laws
and regulations, if any, affecting said property though they may be unrecorded.
Grantor, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty, grants, sells and conveys to Grantee the property, together
with all and singular the rights and appurtenances thereto in any wise belonging, to have
and hold it to Grantee, Grantee's heirs, executors, administrators, successors, or assigns
forever. Grantor binds Grantor to warrant and forever defend all and singular the property
to Grantee and Grantee's heirs, executors, administrators, successors, and assigns against
every person whomsoever lawfully claiming or to claim the same or any part there except
as to. the reservations from and exceptions to conveyance and warranty, when the claim is
by, through, or under Grantor, but not, otherwise.
"CONDITION OF PROPERTY AS-IS"
As a material part of the consideration for this deed, Grantor and Grantee agree that
Grantee is taking the Property "AS IS" with any and all latent and patent defects and that
there is no warranty by Grantor that the Property has a particulaz financial value or is fit
for a particulaz purpose. Grantee acknowledges and stipulates that Grantee is not
relying on any representation, statement, or other assertion with respect to the Property
condition but is relying on Grantee's examination of the Property. Grantee takes the
Property with the express understanding and stipulation that there are no express or
implied warranties as to the physical condition.
