RE: PR 21918 Resolution authorizing a non-exclusive contract between the City of
Port Arthur and the Industrial Safety Training Council.
Introduction:
The intent of this Agenda Item is to seek the City Council's approval to enter into a non-
exclusive contract with the Industrial Safety Training Council of Jefferson County, Texas to
provide services, to the City as a result of a disaster.
Background:
In the case of a declared disaster,the City of Port Arthur is in need of living quarters and space
for emergency operations center(EOC), activities and other emergency response and recovery
activities during a sustained natural or manmade disaster for essential personnel and all first
responders. Therefore the city of Port Arthur requests or deems necessary the need for the
Industrial Safety Training Council to fill the aforementioned required parameters.
Budget Impact:
The city of Port Arthur agrees to pay for the services, supplies, accommodations, and or
conference rooms for all city government activities while in use during the sustained response
and recovery activities.
Recommendation:
It is recommended that City Council approve to enter into a non-exclusive contract with the
Industrial Safety Training Council of Jefferson County, Texas as to provide services, supplies,
accommodations, or conference rooms in case of an emergency.

RESOLUTION NO.
A RESOLUTION AUTHORIZING A MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF PORT ARTHUR AND
INDUSTRIAL SAFETY TRAINING COUNCIL (ISTC) TO PROVIDE
SERVICES, SUPPLIES, ACCOMMODATIONS, AND/OR CONFERENCE
ROOMS IN THE CASE OF AN EMERGENCY OR DISASTER.
WHEREAS, the City of Port Arthur desires to enter into a Memorandum of
Understanding (MOU) with the Industrial Safety Training Council (ISTC) of Beaumont,
Jefferson County, Texas to provide services, supplies, accommodations, or conference
rooms in case of an emergency, as delineated in Exhibit "A", with the term of the
Agreement from June 22, 2021 to June 22, 2023; and
WHEREAS, in the event of an emergency or disaster whereby a local disaster has
been declared pursuant to Sections 418 and 433 of the Texas Government Code it is
necessary to enter into a Memorandum of Understanding with ISTC for the use of its
facility to conduct emergency operations and use as a shelter for those city employees,
officers and officials providing service to the City as a result of a disaster; and
WHEREAS, the ISTC has a facility located at 3749 US-69 Beaumont, Jefferson
County, Texas, which is suitable for these emergency sheltering operations; and
WHEREAS, the City desires to enter into a MOU with ISTC for the use of its facility
as an emergency evacuation and operations shelter.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City of Port Arthur is herein authorized to enter into
Memorandum of Understanding with the Industrial Safety Training Council of Beaumont,
Jefferson County, Texas, as to provide services, supplies, accommodations, and/or
conference rooms in case of an emergency or declared disaster, in substantially the same
form as delineated in Exhibit "A", with the term of the Agreement from June 22, 2021 to
June 22, 2023.
Section 3. That a copy of the caption of this Resolution be spread upon the
Minutes of the Corporation.
READ, ADOPTED AND APPROVED on this day of June, A.D., 2021, at a
