AN ORDINANCE ADDING SECTION 18-44 TO CHAPTER 18 OF THE CODE OF ORDINANCES AS IT PERTAINS TO ECONOMIC INCENTIVES FOR NEW COMMERICAL ENTITIES PROVIDING FOR AN EFFECTIVE DATE WHEREAS,the City Council deems it in the best interests to add Section 18-44 to Chapter 18 of the City of Port Arthur's Code of Ordinances: and, NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Chapter 18 of the Code of Ordinances is hereby amended by adding a new Section 44 which shall read as follows: "Section 44—New Commercial Entity Economic Incentive" In order to promote growth of the local economy and to encourage the construction of commercial structures within the city, an economic incentive program is authorized. The City Manager is authorized to waive water tap fees and sewer tap fees for commercial structures of new business entities that are located within the corporate limits of the City of Port Arthur in an amount not to exceed $10,000. Applicants need to pre-qualify for the program. A new certificate of occupancy is required for the business to be eligible for program. The request must be in writing and show the following: (1) Name, address and phone number of applicant and proof of ownership. (2) Location of the commercial business. (3) Description of the type of commercial business (4) Timetable for construction. (5) Expected number of employees to be hired; and (6) Property taxes must be current at the time of the application and remain current for a period of five years. Section 3. That this being an Ordinance amending an Ordinance which does not carry a penalty, and does not require publication, it shall take effect immediately from and after its passage. Section 4. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council.
