ORDINANCE NO.
AN ORDINANCE ADDING SECTION 106-225 TO
CHAPTER 106 OF THE CODE OF ORDINANCES AS IT
PERTAINS TO TRAFFIC AND AS TO PROHIBIT
PARKING ON PORTIONS OF SEVENTH (7TH) STREET,
PROVIDING FOR AN EFFECTIVE DATE AND FOR
PUBLICATION (REQUESTED BY COUNCILMEMBER
JONES)
WHEREAS, the City Council deems it in the best interests to add Section 106-225 to
Chapter 106 of the City of Port Arthur's Code of Ordinances; and,
NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Chapter 106 of the Code of Ordinances is hereby amended by adding
a new Section 106-225 which shall read as follows:
"Section 106-225 - Prohibited on portion of Seventh (7th) Street.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind
in, upon or along both sides of Seventh (7th) Street from Woodworth Boulevard to Ninth
(9th)Avenue.
(b) Appropriate signs giving notice of the provisions of this section shall be placed in the
appropriate locations."
Section 3. That this being an Ordinance which requires publication, its caption shall
be published at least one (1) time within ten (10) days after final passage hereof in the official
newspaper of the City of Port Arthur. and this Ordinance shall take effect immediately after the
date of publication.
Section 4. That a copy of the caption of this Ordinance be spread upon the Minutes of
the City Council.

Sec. 106-211. - Prohibited at certain places; no signs required; moving vehicles.
(a) Except as provided by subsections (c) and (d) of this section and except when necessary to avoid
conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic
control device, no person shall:
(1) Stop, stand or park a vehicle:
a. On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
b. On a sidewalk;
c. Within an intersection;
d. On a crosswalk;
e. Between a safety zone and the adjacent curb or within 30 feet of points on the curb
immediately opposite the ends of a safety zone, unless a difference length is indicated by
signs or markings authorized by city ordinance;
f. Alongside or opposite any street excavation or obstruction when stopping, standing or parking
would obstruct traffic;
g. Upon any bridge or other elevated structure upon a highway or within a highway tunnel;
h. On any railroad track except as allowed by section 106-213;
i. At any place where official signs prohibit stopping;
j. On any public property that is owned by the city, including parks and esplanades, that is not
designated as a road, alley or parking area. Violation of this subsection shall be punishable
by a minimum fine of$100.00 and a maximum fine of$500.00.
(2) Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a
passenger:
a. In front of a public or private driveway;
b. Within 15 feet of a fire hydrant;
c. Within 20 feet of a crosswalk at an intersection;
d. Within 30 feet upon the approach to any flashing signal, stop sign, yield sign or traffic control
signal located at the side of a roadway;
e. Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite
the entrance to any fire station within 75 feet of such entrance (when properly signposted);
f. At any place where official signs prohibit standing.
(3) Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually
engaged in loading or unloading merchandise or passengers:
a. Within 50 feet of the nearest rail of a railroad crossing;
b. At any place where official signs prohibit parking.
(b) No person shall move a vehicle not lawfully under his control into any such prohibited area or away
from a curb such a distance as is unlawful.
(c) A person may stop, stand or park a bicycle on a sidewalk if the bicycle does not impede the normal
and reasonable movement of pedestrian or other traffic on the sidewalk.
(d) Private vehicles operated by contractors responding to any emergency are exempt from the
restrictions of subsections (a)(1)a, e, f and i, (a)(2), and (a)(3) of this section.

Sec. 106-212. - Punishment provisions for parking in areas specifically designated for disabled.
Pursuant to V.T.C.A., Transportation Code § 681.001 et seq., § 502.253, the offense and
punishment provisions of section 10 of such provision shall apply to any parking space or area for the
disabled on private property designated in compliance with the same requirements in such article which
are applicable to political subdivisions. An offense under V.T.C.A., Transportation Code § 681.011 is a
class C misdemeanor and is punishable by fine not exceeding $500.00 or as otherwise provided under
state law.

Sec. 106-213. -Stopping on railroad tracks.
It shall be unlawful for a person to stop, stand or park a vehicle otherwise than temporarily for the
purpose of and while actually engaged in loading or unloading upon, along or across any railroad track
within the limits of the city so as to interfere with the normal movements of railroad cars along such track.

Sec. 106-214. - Parking in alleys.
No person shall park a vehicle (other than temporarily parking commercial vehicles) within an alley in
such a manner or under such conditions as to leave available less than ten feet of width of the roadway
for the free movement of vehicular traffic; provided, however, that there shall be no parking in all alleys
located between Augusta Avenue and Houston Avenue from Seventh Street on the north to Lakeshore
Drive on the south (other than the temporary parking of commercial vehicles for the purposes of loading
and unloading). No person shall stop, stand or park a vehicle within an alley in such position as to block
the driveway entrance to any abutting property.

Sec. 106-215. - Night parking of commercial vehicles.
No person shall park any truck, bus or other commercial vehicle on any street between the hours of
10:00 p.m. and 5:00 a.m.

Sec. 106-216. -Time limit in passenger curb loading zone.
No person shall stop, stand or park a vehicle for any purpose or length of time other than for the
expeditious loading or unloading of passengers in any place marked as a passenger curb loading zone
during hours when the regulations applicable to such curb loading zones are effective, and then only for a
period not to exceed three minutes unless otherwise designated by signs.

Sec. 106-217. -Time limit in freight curb loading zone.
No person shall stop, stand or park a vehicle for any purpose or length of time other than for the
expeditious unloading and delivery or pickup and loading of materials in any place marked as a freight
curb loading zone during hours when the provisions applicable to such zones are in effect. In no case,
shall the stop for loading and unloading of materials exceed 30 minutes unless otherwise designated by
signs.

Sec. 106-218. - Public carrier stops and zones.
(a) Designation. The chief of police, the director of public works or the director of transit is authorized to
establish bus stops, bus zones, taxicab zones and other similar zones on such public streets in such
places and in such number as to be the greatest benefit and convenience to the public.
(b) Restricted use. No person shall stop, stand or park a vehicle other than a bus in a bus stop or bus
zone, or other than a taxicab in a taxicab zone when any such stop or zone has been officially
designated and appropriately signed. The driver of a passenger vehicle may temporarily stop therein
for the purpose of, and while actually engaged in, loading or unloading passengers when such stopping
does not interfere with any bus or taxicab waiting to enter or about to enter such zone.
(c) Buses and taxicabs; regulations.
(1) The operator of a bus shall not stand or park such vehicle upon any street at any place other
than a bus stop or bus zone so designated as provided in this section.
(2) The operator of a bus shall not stop such vehicle upon any street at any place for the purpose of
loading or unloading passengers or their baggage other than at a bus stop, bus zone or passenger
loading zone so designated as provided in this section, except in case of an emergency.
(3) The operator of a bus shall enter a bus stop, bus zone or passenger loading zone on a public
street in such a manner that the bus, when stopped to load or unload passengers or baggage,
shall be in a position with the right front wheel of such vehicle not further than 18 inches from the
curb and the bus approximately parallel to the curb so as not to unduly impede the movement of
other vehicular traffic.
(4) The operator of a taxicab shall not stand or park such vehicle upon any street at any place other
than in a taxicab zone so designated as provided in this section. This subsection shall not prevent
the operator of a taxicab from temporarily stopping in accordance with other stopping or parking
regulations at any place for the purpose of, and while actually engaged in, the expeditious loading
or unloading of passengers.

Sec. 106-219. - Restricted at city hall.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind in, upon or
along the access driveway of the city hall from the intersection of Fourth Street and Austin Avenue,
except where standing and loading are allowed.
(b) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind in the
loading zones on the public parking lot adjacent to the city hall except for those vehicles during the
loading or unloading of merchandise, supplies or materials.
(c) Appropriate signs giving notice of the provisions of this section shall be placed in the appropriate
locations.

Sec. 106-220. - Prohibited on portion of Gulfway Drive.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind in, upon or
along Gulfway Drive from Woodworth Boulevard to Terminal Road.
(b) Appropriate signs giving notice of the provisions of this section shall be placed in the appropriate
locations.

Sec. 106-221. - Prohibited on portions of West Seventh Street.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind in, upon or
along both sides of West Seventh Street from Houston Avenue to Marian Anderson Avenue and the
north side of West Seventh Street from Lincoln Avenue to Highway 82.
(b) Appropriate signs reading "no parking any time," in either written or symbol form, shall be placed on
both sides of West Seventh Street from Houston Avenue to Marian Anderson Avenue and on the north
side of West Seventh Street from Lincoln Avenue to Highway 82.

Sec. 106-222. - Prohibited on portion of Sixth Street.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind, in, upon or
along the north side of Sixth Street from Austin Avenue to Fort Worth Avenue on Saturdays from 7:00
p.m. to 7:00 a.m.
(b) Appropriate signs giving notice of the provisions of this section shall be placed in the appropriate
locations.

Sec. 106-223. - Prohibited on portions of Lakeshore Drive.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind in, upon, or
along the 1600 through the 1800 blocks on the north side of Lakeshore Drive.
(b) Appropriate signs giving notice of the provisions of this section shall be placed in the appropriate
locations.

Sec. 106-224. - Prohibited on portions of New Orleans Avenue.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind in, upon, or
along the east side of the 500 block of New Orleans Avenue.
(b) Appropriate signs giving notice of the provisions of this section shall be placed in the appropriate
locations.
Section 106-225- Prohibited on portion of Seventh (7th) Street.
(a) It shall be unlawful for any person to park or leave standing any motor vehicle of any kind in, upon
or along both sides of Seventh (7th) Street from Woodworth Boulevard to Ninth (9th)Avenue.
(b) Appropriate signs giving notice of the provisions of this section shall be placed in the appropriate
locations.
