HomeMy WebLinkAboutPR 22015: REJECT PROPOSALS FOR CONSTRUCTION MANAGER FOR TRANSIT DEPARTMENT iik City of Port Arthur Transit Department Memorandum To: Ron Burton, City Manager A From: Ivan Mitchell, Transit Director 9 1` Cc: Clifton Williams, Procurement Manager Date: July 9, 2021 Subject: P.R. 22015 - Reject Proposals for Construction Manager for Transit Department Projects Background: The City's Purchasing Department advertised Port Arthur Transit's (PAT) request for proposals for a construction manager in the Port Arthur News on June 12 and June 19, 2021. The City received and opened two (2)proposals. The two bidders are listed below. Bidder Sigma Engineers John S. Polk PAT's construction projects consist of federal and state mandated clauses such as Buy America, Davis-Bacon, and Disadvantaged Business Enterprises (DBE)to name a few. Due to the nature of these clauses, it is critical a construction manager has significant expertise and experience in working with projects under these requirements. After evaluating both proposals,the proposers did not possess a high level of expertise and experience regarding the clauses mentioned above. PAT wishes to reject the two (2) proposals and readvertise. Recommendation: PAT is recommending the City of Port Arthur's City Council approve Proposed Resolution No. 22015 to reject the two (2)proposals received and authorize the Purchasing Division to re- advertise the request for proposals. Budgetary/Fiscal Effect: The funding for this project is in PAT's capital budget. P.R. No. 22015 7/9/2021 IM RESOLUTION NO. A RESOLUTION AUTHORIZING THE CITY MANAGER TO REJECT THE TWO (2) PROPOSALS FOR A CONSTRUCTION MANAGER FOR PORT ARTHUR TRANSIT (PAT) CONSTRUCTION PROJECTS WHEREAS, Port Arthur Transit (PAT) has allotted federal and TxDOT funding to upgrade its facilities; and, WHEREAS, PAT issued a request for qualifications for qualified vendors to submit proposals, wherein two (2) bids were received, and have been evaluated by Purchasing and PAT, a copy is attached hereto as Exhibit"A"; and, WHEREAS, PAT's construction projects consist of federal and state mandated clauses such as Buy America, Davis-Bacon, and Disadvantaged Business Enterprises (DBE) to name a few; and, WHEREAS, the evaluation rendered that the proposals did not possess the level of expertise and experience with projects that are guided by federal and state clauses; and, WHEREAS, PAT requests the City Council to authorize the City Manager to reject both proposals based on this fact. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct. THAT, the City Manager is hereby authorized to reject the two (2) proposals received and authorize the Purchasing Division to re-advertise the request for proposals. THAT, the Purchasing Division is hereby authorized to re-advertise. THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
