Alexander, MBA-HCM, Health Director DATE: December 8, 2008 SUBJECT: Proposed Resolution No. 15030 Approval and Acceptance of the Certificate of Substantial Completion From SeTEX Construction Corporation RECOMMENDATION It is recommended that the City Council approve P.R. No. 15030, approving and accepting the Certificate of Substantial Completion from SeTEX Construction Corporation for renovations to the Second Floor of the Health Department. BACK The project for renovations to the second floor was made possible through grant funds awarded for the Social Services Block Grant (SSBG) in December 2006. The project initially began in May 2007 with Pick Two Contractors. Upon termination of that contract in the Spring of 2008, SeTEX Construction Corporation was hired in August 2008. The work performed by SeTEX Construction Corporation was reviewed on November 26, 2008 and found to be substantially complete. The Corporation is requesting that the City of Port Arthur approve and accept the Certificate.of Substantial Completion. BUDGETARY AND FISCAL EFFECT None. STAFFING EFFECT None. SUMMARY It is recommended that the City Council approve P.R. No. 15030, approving and accepting the Certificate of Substantial Completion from SeTEX Construction Corporation for renovations to the Second Floor of the Health Department. P.R. A RESOLUTION TO APPROVE AND ACCEPT THE CERTIFICATE OF SUBSTANTIAL COMPLETION FOR RENOVATIONS TO THE SECOND FLOOR OF THE PORT ARTHUR HEALTH DEPARTMENT WHEREAS, the work performed under the. Contract with SeTEX Construction Corporation for renovations to the second floor of the Port Arthur Health Department has been reviewed and found to be substantially complete as of November 26, 2008; and, WHEREAS, the Contractor is requesting approval and acceptance of the Certificate of Substantial Completion. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That, the facts and opinions in the preamble are true and correct; Section 2. That, the City Council of the City of Port Arthur hereby approves and accepts the Certificate of Substantial Completion as .submitted by SeTEX Construction Corporation; Section 3. That, the City Council deems it is in the best interest of the City to authorizes the City Manager to execute said Certificate of Substantial Completion as delineated in Exhibit "A;" Section 4. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. P.R. The Date of Substantial Completion of the Project or portion thereof designated above- is hereby established as November 26, 2008 which is also the date of commencement of applicable warranties required by the Contract documents, except as stated below. _ -_ __ _......r. ur~wi rnMDl FTI(1N The date of Substantial Completion of the Work or designated portion thereof is the Date certified by the Architect when construction is sufficiently complete, in accordance with the Contract Documents, so the Owner can occupy or utilize the Work or designated portion thereof for the use for which it is intended, as expressed in the Contract Documents. OWNER BY The responsibilities of the Owner and the Contractor for security, maintenance, heat, utilities, damage to the Work and insurance shall be as follows: Owner will assume responsibility for maintenance, security, and damage to the Work on the Date of Substantial Completion except for damage done by Contractor or Subcontradtors during final completion. Owner assumes responsibility for insurance of the Project on November 27, 2008. The Contractor will submit to the Owner the executed warranties, maintenance agreements, inspection certificates, record documentation, maintenance manuals, tools, spare parts, keys and similar operational items by December 27, 2008.
