ORDINANCE NO.
AN ORDINANCE DESIGNATING A REINVESTMENT ZONE
FOR TAX ABATEMENT ON A 134..01.9 ACRE TRACT OF'
LAND AND ON A 19.916 ACRE TRACT OF LAND THAT
TEXAS OFFSHORE PORT SYSTEM COMPANY, LLC PLANS'
TO BUILD ANEW CRUDE. OILS STORAGE TERMINAL
WHEREAS, under Chapter 312, Property Development of the Texas
Property Tax Code, a municipality may designate an area as a
"Reinvestment Zone"; and
WHEREAS., a public hearingawas held on December 16, 2008 to
take comments on the proposed designation; and
WHEREAS, notice. of this hearing was provided to the .presiding
officer of-all taxing units that include in their boundaries the
property that is to be included in the Zone.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE. CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble
are true and correct.
Section 2. That the following tracts of land are hereby
designated. as a °Reinvestment Zone" for commercial/industrial tax
abatement, under Chapter 312 of the Texas Property Code:.
"134.019 Acre Tract, also :being all of Lots 1, 2, 3, 7,
and 8 and a portion of Lots 4,'S, and 6, Block 11,
Range "O", attached hereto as Exhibit_"A"
19.916 Acre Tract, also being ,out of Lots 5 and 6,
Block 11, Range "0", attached hereto as Exhibit "B"."
Section 3. That the City Council finds that the
designation of the Reinvestment Zone would like result in the

retention or expansion of primary employment or attract major
investment in the zone that would benefit the property and that
would contribute to the economic development of the City.
Section 4. That the City Council finds that the
improvements proposed are feasible and practical and would be a
benefit to the land to the land to be included in the Investment
Zone and to the City after the expiration of an Agreement entered
into by the City.
Section 5. That if any section, subsection, sentence,
clause, phrase, or portion of this Ordinance, is for any reason
held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct,
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
Section 6. That the term of this designation shall be
five (5) years from the effective date of this Ordinance and may
be renewed for periods of five (5) years.
Section 7. That all Ordinances and parts of Ordinances
in conflict herewith are hereby repealed, but only to the extent
of such conflict.
Section 8. That a copy of the caption of this Ordinance
be spread upon the Minutes of the City Council.
Section 9. That this being an Ordinance which does not
carry a penalty and does not require publication, it shall take
effect immediately from and after its passage.
