EDC-090 Dear Mr. Batiste: On December 3, 2008, the City of Port Arthur Purchasing Department received five (5) sealed bids for the PAEDC's project noted above. The legal notices for this project were advertised in the Port Arthur News for two consecutive Sundays as required by the City. Additionally, the Plans and Specifications for the project were placed on file locally with the Associated General Coniactors, the PAEDC and at our offices. The Engineer conducted a mandatory pre-bid meeting on November 25, 2008 with seven (7) contractors in attendance. The bids were opened in my presence at 3:15 p.m. today and the results were read aloud by me. I have checked the bids submitted'and have prepared the attached Bid Tabulation for your review. The lowest, responsive bid was received from the firm of Excavators B Constructors, Ltd. whose principal office is in Port Arthur, TX. Their Total Amount Bid' for this project is $782,590.72. The fine submitted the required bid surety and other cert'fiicetions required in the Bid Proposal. The four remaining bids submitted for this project ranged from approximately $885,600 to $1,044,000. The Engineer's Estimate for this project prepared by our firm and reported to you in October 2008 was $1,0?9,079. In consideration of elf bids received, we recommend that-the Port Arthur EDC approve the award of this contract to Excavators 8c Constructors, Ltd. on the basis their firth submitted the lowest, responsive bid. We recommend that the bid surety from the three lowest bidders be retained until a contract is executed. EDC-090 LOCATED AT 9555 W. PORT ARTHUR ROAD TO EXCAVATORS & CONTRACTORS, LTD. WHEREAS, on November 16, 2008 and November 23, 2008, the City of Port Arthur Section 4A Economic Development Corporation (the "PAEDC°) advertised for bids in the Port Arthur News for the construction of water, sanitary sewer, paving and drainage facilities to serve the PAEDC Business Pazk Phase II, Contract 1-Project No. EDC-090 located at 9555 W. Port Arthur Road; and WHEREAS, bids were opened on December 3, 2008 (a copy of the bid tabulation is attached hereto as Exhibit "A"); and WHEREAS, at its December 3, 2008 meeting, the Boazd of Directors of the City of Port Arthur Section 4A Economic Development Corporation (the "PAEDC") approved the award of the bid in the amount of $782,590.72 from Excavators & Contractors, Ltd of Port Arthur, Texas, who was determined to the lowest and most responsible bidder; and WHEREAS, pursuant to Section 8.19 of the Bylaws, the PAEDC has to submit projects to the City Council for review and approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. Thaf the City Council authorizes the City Port Arthur Section 4A Economic Development Corporation to award a bid in the amount of $782,590.72 to Excavators & Contractors, Ltd. and enter into a contract for the construction of water, sanitary sewer, paving and drainage facilities to serve the PAEDC Business Park Phase II, Contract I -Project No. EDC-090 located at 9555 W. Port Arthur Road, in substantially the same form as Exhibit "B". Section 3.
