SUBJECT: Adoption of Proposed Ordinance No. 5963 Adopting a Collective
Bargaining Agreement between the Port Arthur Police Association and the
City of Port Arthur
COMMENTS
I recommend adoption of Proposed Ordinance No. 5963 adopting a three (3) year collective
bargaining agreement between the Port Arthur Police Association and the City of Port Arthur.
Said agreement will be effective October 1, 2008 through September 30, 2011.
The proposed contract is essentially status quo; however, significant changes are as follows:
Article II-Duration: Three (3) year contract beginning October 1, 2008 through September 30,
2011.
Article XIV-Seniority: Removes Seniority List from contract. Removes reference. to
departmental policy in 1991. Provides for an adjusted-service date and service credit for Police
Officers that have separated and will reach, or have reached, five (5) years of continuous re-
employment as a Police Officer.
Article XVIII-Wages: Year 1-4.5% effective 10/01/08; $100/mo: added to base wage of
sergeants and lieutenants to principally complete salary adjustments.
Year 2-5% effective 10/01/09; $100/mo. to complete salary adjustments for sergeants and
lieutenants.
Year 3-5.5% effective 10/01 /10.
Article XIX-Field Training Officer Pay: Increased pay from $50/mo. to $100/mo.
Article XXIII-Residencv: Increased down payment and closing cost allowance for Police Officers
who purchase a home in a city non-target area from $1,500 to $2,500; from $3,000 to $4,000 for
Police Officers who purchase a home in a target area.
Increased the moving cost assistance for Police Officers who move into arental/lease residence
in the city from $400 to $500.
Increased the monthly rental assistance from $75/mo. to $100/mo. for Police Officers living in a
non-target area; from $150/mo. to $200/mo. for Police Officers in targeted area.
Increased the monthly housing expense from $75/mo. to $150/mo. for Police Officers that reside
in anon-target area; from $150/mo. to $300/mo. for Police Officers residing in a target area.

Article XXXII-Medical and Dental Insurance: Provides that the premiums of Association
members-shall not exceed those of non-Civil Service employees.
Article XXXVII-Psvcholoaical Services: Provides that following a critical incident a Police Officer
may request to have services provided by a mental health. professional of his/her choice the
cost of which, ff the City agrees, will be paid by the City.
Provides that officers referred for services under this article will sign a "Release~of Inforrnation"
form, but only as pertains to the incident giving rise to the referral and the ability of the officer to
effectively execute the duties of a peace officer without danger to himself or others.-
Article XLI-Drug and Alcohol Policy: Provides that each member of the sworn personnel will
undergo a random drug and alcohol test during calendar year 1/1 to 12/31; additionally, the City
can randomly test up 50% of all police officers during one year period.
Article XLII-Inclement Weather: In case of a major disaster which is of such severity and
magnitude to warrant an emergency declaration by the President under the Robert T. Stafford
disaster Relief and Emergency Assistance Act and similar legislation, civil service workers will
receive inclement weather pay in an amount not to exceed eight (8) hours per day for the time
that they. expend acting as emergency service workers during the disaster.

ORDINANCE NO.
AN ORDINANCE APPROVING A COLLECTIVE BARGAINING AGREEMENT
BETWEEN THE CITY OF PORT ARTHUR AND
THE PORT ARTHUR POLICE ASSOCIATION
PROPOSED FUNDING: POLICE DEPARTMENT BUDGET
ACCOUNT NO. 001-1101x21.11-00
WHEREAS, the City of Port Arthur has negotiated a Collective Bargaining
Agreement with the Port Arthur Police Association pursuant to Chapter 174 of the Texas
Local Government code annotated, the Fire. and Police Employees Relation Act.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the Mayor and City Manager are hereby authorized to execute
said Collective Bargaining Agreement on behalf of the City in substantially the same
form as Exhibit "A" (attached hereto):
Section 3. That the effective period of the contract shall be October 1, 2008
through September 30, 2011.
Section 4. That a copy of the caption of this Ordinance be spread upon the
Minutes of the City Council.
READ, ADOPTED, AND APPROVED on this day of
A.D., 2008, at a Regular Meeting of the City Council of the City of Port Arthur, Texas, by
