COMMENT RECOMMENDATION: Staff recommends that the City Council adopt P. R. No. 14994, authorizing the City Manager to execute aone-year contract between the City of Port Arthur and Cordon's Lawn Service,. for the contract amount of $.002 per square foot for privately-owned and City-oNmed developed property in Area? C. Area C is that area of the City of Por[ Arthur roughly bounded on the north by Highway 73, on the east by Woodworth Boulevard/iJ.S. Highway 69, on the South by Lakeshore Drive, and on the West by Savannah Avenue. BACKGROUND: Bids were opened on November 19, 2008 CORDON'S LAWN SERVICE was the lowest and best bidder to wit for the mowing of vacant lots in Area C for the amount of $.002 per square foot. This contract is for one year with City's option to renew for two (2) additional years. STAFF LEVEL IMPACT: Adoption of this proposed resolution will have no effect on current staffing level. SUMMARY: Staff recommends that the City Council adopt P. R. No. 14994, thereby authorizing the City Manager [o execute a contract with Cordon's Lawn Service for the mowing of grass on privately-owned (where owners have failed [o maintain the property) and City-owned vacant property in Area C. That forthe purposes of this Resolution, Area C is that area of the Cityof Pon Arthur roughly bounded on the north by U.S. Ihghway 73, on the East by Woodworth Boulevani/U.S. Highway 69, on the South by Lakeshore Drive, and on the West 6ySavannah Avenue; and Section 3. That forthe purposes of this resolution, a developed lot is defined as a lot orparcel of land which has one or more buildings on it and a vacant lot is defined as a lot or parcel of land with no buildings on it; and Section 4. The award if made. shall be made to the responsible vendor(s) whose bid is determined to be the lowest offer: taking into consideration the relative importance of price, conformance to specifications and capability and experience of the contractor. TERiyIIIVOLOGY: "Bid" vs. "Proposal"--For the purpose of this.ITB; the terms "Bid" and Proposal" shall be equivalent. CONFLICT OF INTEREST: No public official shall vote on this contract in violation of Chapter 171 Local Government Code. ETHICS: The bidder shall not offer or accept gifts or anything of value, nor enter into any business arrangement with any employee; official or agent of the City of Port Arthur. MINIMUM STANDARDS FOR RESPONSIBLE PROSPECTIVE BIDDERS: A prospective bidder must affirmatively demonstrate bidder's responsibility. A prospective bidder must meet the following requirements: 1. Be able to comply with the required of proposed delivere schedule. 2. Be otherwise qualified and eligible to receive an award. 3. Be engaged in a full time business, and can assume liabilities for any performance or warranty service required. 4. The City Council shalt not award a contract to a company that is in arrears in its obligations to the City. 5. No payments shall be made to any person of public moneys under any contract by the City with such person until such person has paid all obligations and debts owed to the City, or has made satisfactory arrangements to pay the same. Any interpretations, corrections or changes to the ITB and Specifications will be made by _ addenda. Sole issuing authority of addenda shall be vested in the City of Port Arthur's Purchasing Manager. Addenda will be mailed to all who are known to have received a copy of the ITB. Offerors shall acknowledge receipt of all addenda. BONA FIDE BUSINESS THAT CLAIiVIS THE CITY OF PORT ARTHUR AS ITS PRINCIPAL PLACE OF BUSINESS: The official business address (office location and. office personnel) shall be a Port Arthur address, the principal storage place or facility for the equipment shall be in Port Arthur and/or the place of domicile for the principal business owner(s) shall be in Port Arthur or such other definition or interpretation as is provided by state law. Page 5 of 19 PRICES: The bidder should show in the proposal both the unit price and total amount, where required. of each item listed. In the event of error or discrepancy in the mathematics; the unit price shall prevail: PURCHASE ORDER: A purchase order(s) shall be generated by the City of Port Arthur to the successful bidder. The purchase order number must appear on all itemized invoices. INVOICES: All invoices shalfbe mailed directly to the City of Port Arthur, Atm.: Environmental Health; P. 0. Box 1039, Port Arthur, Texas 77641. PAYMENT: Payment will be made upon receipt of rivo (2) original invoices and verification by Envirorunental Health the work has been done properly. SALES TAY: The City of Port Arthur is exempt by law from payment of Texas Sales Tax and Federal Excise Tax; therefore the proposal shall not include Sales Tas. VENUE: This agreement will be governed and construed according to the laws of the State of Texas. This agreement is performable in Port Arthur, Texas. Venue shall be in Jefferson County. COMPLLANCE R'ITH LA~'6S: The Contractor shall comply with all applicable laws, ordinances; rules; orders, regulations and codes of the federal, state and local governments relating to performance of work herein. INTEREST OF bIENIBERS OF CITY: No member of the governing body of the Cit_v, and no other officei; employee or anent of the City who exercises any functions or responsibilities in connection with the planning and carrying out of the program; shall have any personal financial interest; direct or indirect; in this Contract as provided by Chapter ~ 73 Government Code; and; the Contractor shall take appropriate steps to assure. compliance. ~ DELINQUENT PAYMENTS DUE CITY': The City of Port Arthur Code of Ordinances prohibits the City from granting any license, privilege or paying money to anyone owing delinquent lases, paving assessments or any money to the City until such debts are paid or until satisfactory arrangements for payment has been made. It is specifically understood and agreed that these quantities are approximate and any additional quantities will be paid for at the quoted price. It is further understood that the contractor shall not have any claim against the City of Port Arthur for quantities less than the estimated amount. CONTRACTOR'S OBLIGATIONS: The Contractor shall and wi[L in good workmanlike manner, perform all work and furnish all supplies and materials, machinery, equipment, facilities and means; except as herein otherwise expressly specified, necessary or proper to perform and complete all the work required by this Contract. in accordance with the provisions of this Contract and said specifications. The apparent silence of these specifications as to any detail or to the apparent omission from it of a detailed description concerning any point shall be regarded as meaning that only the best commercial practices are to prevail. While the purpose of the specifications is to indicate minimum requirements in the way of capability, performance, construction, and other details; its use is not intended to deprive the City of Port Arthur the option of selecting goods which may be considered more suitable for the purpose involved. In the event of conflicts beriveen the written bid proposal and information obtained verbally, the vendor is specifically advised that the written bid proposal will prevail in the determination ofthe successful bidder. Under the Title VI of the Civil Rights Act of 1964, no person shall; on the grounds of race, color, or. national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. TERMINATION FOR CAliSE: If, through any cause, the Contractor shall fail to fulfill in a timely and proper manner his obligations under this contract, or if the Contactor shall .violate anv of the covenants, agreements or stipulations of this contract, the City shall thereupon have the right to terminate this contract by givingwritten notice to the Contractor of such termination and specifying the effective date thereof; at least fifteen (I ~) days before the effective date of such termination. Notwithstanding the above, the Contractor shall not be relieved of liability to the City for damages sustained by the City b}' virtue ofany breach of the contract by the Contractor; and the City may withhold any payments to the Contractor for the purpose ofset-off until such time as the exact amount of damages due the City from the Contractor is determined. TERMINATION FOR CONVENIENCE: The City may terminate this contracYat any time giving at least thirty (30) days notice in writing to the Contractor. If the Contract is terminated by the City as provided herein, the Contractor will be paid for the service that it has perfornred up to the termination date. If this contract is terminated due to fault of the Contractor, the previous paragraph hereof relative to termination shall apply. EXPERIENCE & CAPABILITY: Bidder shall include the following information to describe the experience and capability factors of the company: (This information must be included with contractor's submitted bid proposal) 1. Number of years in operation. 2 Largest area mowed currently in effect with a business. 3. Number of employees currently employed, their job titles; and their job descriptions. 4. Documentation proving you have the required equipment stated in the specifications ~. Be otherwise qualified and eligible to receive an award. 6. -Other major companies or areas that it has contracted to mow. 7. ~If a company wants to cut more than two (2) areas of the City,'the company must show that it has the equipment and employees to handle more than two areas. 8. Existing mowing schedule for your existing contracts and your proposed mowing schedule for all of the areas that you bid based on the expected volume of cutting in these areas. 9. If you plan to expand your employees and your equipment to handle the areas to be bid, please provide information indicating your capabilities to maintain those areas. RELEASES AND RECEIPTS: The City of Port Arthur, before making payments, may require the Contractor to furnish releases or receipts for any or all persons performing work and supplying material or service to the Contractor, or any sub-contractors for work under this contract, if this is deemed necessary to protect its interests. Page 8 of 19 CARE OF WORK: The Contractor shall be responsible for all damages to person or property that occurs as a result of his fault or negligence in connection with the work performed until completion and final acceptance by the City. SLB-CO`ITR4CTS: The Contractor shall not execute an agreement with any sub- contractor or permit any sub-contractor to perform any work included in this Contract until he has received from the City of Port Arthur written approval of such agreement. INStiR4NCE: All insurance must be written by an insurer licensed to conduct business in the State of Texas, unless otherwise permitted by Owner. The Contractor shall, at his own expense, purchase, maintain and keep in force insurance that will protect against injury and/or damages which may arise out of or result from operations under this contract. whether the operations be by himself or by any subcontractor or by anyone directly or indirectly employed by any of them, or by anyone for whose acts an_v of them may be liable, of the follov«ng types and limits 1. ~ Commercial General Liability occurrence type insurance (City of Port Arthur; its officers, agents, and employees must be named as an additional insured): a. Contractor shall cause Contractor's insurance company or insurance agent to fill in all information required (including names of insurance agency, contractor and insurance companies, and policy numbers, effective dates and expiration dates) and to date and sign and do all other things necessazy to complete and make into valid certificates of insurance Page 9 of 19 and pertaining to the above listed items, and before commencing any of the work and within the time othenvise specified, Contractor shall file completed certificates of insurance wi[h the Owner. None of the provisions in said certificate of insurance should be altered or modified in any respect except as herein expressly authorized. Said CERTIFICATE OF INSURANCE Form should contain a provision that coverage afforded under the policies will not be altered, modified or canceled unless at least fifteen.(1 ~j days prior written notice has been given to the City of Port Arthur. Contractor shall also file with the City of Port Arthur valid CERTIFICATE OF INSURANCE on like form from or for all Subcontractors and showinv the Subcontractor(s) as the Insured. SIZE OF PROPERTIES This contract does not include any lot over one (1) acre in size. J[JNK AND LITTER If there are any problems encountered on city-owned or privately-owned properties scheduled to be mowed, such as junk motor vehicles, additional structures; excessive litter; inability to access property, or inability to mow for any reason, the Contractor should bring these matters to the attention of the City's authorized agent, before attempting to mow. NOTICE TO IVIO«' I . Invoice for lots mowed must be in the Environmental & Consumer Health Division Office no later than 9:00 a. m. on the Thursday before the check run. 2. II is the responsibility of the contractor to obtain the Notice to mow from Environmental Consumer Health on a daily basis. 3. Work must be completed within seven calendar days of issuance. Unless an extension is granted by Environmental & Consumer Health Division; the Contractor wilt be subject to liquidated damages of 525.00 per day for each lot that is not mowed within seven (7j days. 4. Iv1ow grass to a height of not more than 2 inches within 7 days. ~. Time Extension may be granted due to inclement weather or to unforeseeable events that are not caused by the contractor.
