Blackketter, P.E., Director of Public Works SUB7ECT: P.R. # 15039, SCS Engineers for Landfill Levee Repair DATE: December 22, 2008 RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 15039 authorizing the City Manager to execute an agreement with SCS Engineers of Bedford, Texas for designing repairs to the landfill levee for the amount of $6,500. Funds are available in Account No. 403- 1274-533.54-00 in the Public Works-Solid Waste Division FY 2008 Budget. BACKGROUND: Storm surge from Hurricane Ike damaged the north levee at the City's. landfill. This levee is a structural component of the landfill and must be repaired under strict quality control measures. The Natural Resource Conservation Service (NRCS) has offered to provide funding for this repair. SCS Engineers will provide technical guidance to the City and NRCS so that the funding level can be established. ~• BUDGETARY/FISCAL EFFECT: Funds are available in the Public Works-Solid Waste Division FY 2008 Budget, Account No. 403- 1274-533.54-00. EMPLOYEE/STAFF EFFECT: Acceptance of this recommendation will have no effect on staffing levels at this time. Texan 7E021 wwwscsenglneers.com Subject: City of Port Arthur Landfill Hurricane Response Assistance Deaz John: Per your request, and as discussed with Ross Blackketter, Gerald Robinson, and Mike Tentrup, this proposal is to provide the services for assisting the City in its recovery from the impact of Hurricane lke. This includes the following: Providing Technical Guidance to the City and the NRCS for the Reconstruction of the Failed Perimeter Levee. Per the City's request, we have communicated with the NRCS regarding the technical aspects of the levee in an effort to provide adequate guidance for the reconstruction of the levee so that it will furiction per design as an important landfill structure. Consistent with our communications with the City and the NRCS, SCS will provide the NRCS with the following for repair of the Port Arthur Landfill levee: I. Technical Specification for Backfill 2. Three Cross Sections of the Levee 3. Plan View Drawing with Survey Control. Survey control will be provided every 50 to 100 feet at the north toe, south toe, and centerline of levee. November 4, 2008 FEE SCS proposes to do this project for a ump sum of 56,500 which is based on information available to SCS at this time. If conditions change, unforeseen circumstances are encountered, or work efforts aze redirected, the fee estimate may require modification. Any costs in excess of the amount authorized by the City would require City's prior approval. ADDITIONAL SERVICES The above services and related fee are based on our current understanding of the City's needs. The following additional services (not included in the above fees) are provided for the City's future consideration: • Additional follow-up with the TCEQ and/or the NRCS beyond that noted above. • Stuvey services'to staking the plans in the field. It is our understanding that the NRCS will provide the necessary survey control for staking the levee reconstruction. We appreciate the opportunity to be of service to the City of Port Arthur. WITNESSETH That for the considerations set forth below, the parties agree as follows: i, Scope of Services: SCS shall provide services (hereafter "Services") for as defined in SCS' letter of November 4, 2008, in accordance with the terms and conditions of this Agreement. 2. Basis of Compensation: as defined in SCS' letter of November 4; 2008 3, Method of Invoicing: monthly, as defined in SCS' letter of November 4, 2008 4, Professional Retainer: not applicable 5. Other Terms: not applicable (, General Conditions: a. Upon termination, SCS shall be paid for all Services rendered to the date of termination together with any termination expenses incurred. d. Any work in addition to that described in Article 1 above performed at the request of the Clierit shall be compensated on atime-and-materials basis at the rates contained in SCS' Standard Fee Schedule in effect at the time of performance of the Services,. said schedule being attached hereto. e. The parties hereto shall each maintain in full force and effect Cornmercial General Liability insurance with. coverage limits, which are reasonable in light of the Services to be undertaken, and Workers' Compensation Insurance as required by law. SCS will maintain liability insurance in the minimum amount of $1,000,000. £ Any drawings, specifications, reports, data and notes developed pursuant to this Agreement are instruments of service, and as such the original. documents, tracings, and field notes aze and remain the property of SCS. The provisions of this Article 6j shall survive any termination of this Agreement. k.
