RE: A Resolution Approving a Automobile Damage Settlement in the Amount of$22,803.00 for
Damages to City of Port Arthur Water Administration Unit#2268
Nature of the request: On May 17, 2021, a City of Port Arthur Water Administration
employee was performing his work duties in the 3000 Block of 9th Street when the vehicle he
was operating sustained water damage due to flooding in the area.
Staff Analysis, Considerations: The City has Property Damage insurance coverage through
Texas Municipal League Intergovernmental Risk Pool (TML-IRP) with a $2,500.00 deductible.
TML-IRP has offered the City of Port Arthur a settlement of $22,803.00, less the $2,500.00
deductible, making the final settlement offer $20,303.00 (Exhibit "A" attached). This amount is
sufficient to cover all estimated property damages to Unit #2268. If additional damages are
discovered, TML-IRP may issue a supplemental payment.
Recommendation: I recommend approval of Proposed Resolution No. 22085 authorizing the
property damage settlement against TML-IRP for damage sustained to Unit #2268. TML-IRP
has offered to settle the claim for $22,803.00. This is considered a fair and reasonable
settlement for the estimated repairs.
Budget Considerations: The funds received will be deposited in the Insurance Proceeds
Account#410-40-000-4744-00-00-000, HR-Ins Proceeds Water and Sewer FD 410.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE THE SETTLEMENT OF A PHYSICAL DAMAGE CLAIM IN THE AMOUNT
OF $22,803.00 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL
RISK POOL (TML-IRP) AS A RESULT OF PROPERTY DAMAGE TO WATER
ADMINISTRATION UNIT #2268
WHEREAS, on May 17, 2021, a City of Port Arthur Water Administration
employee was performing his work duties in the 3000 Block of 9th Street when the
vehicle he was operating sustained water damage due to flooding in the area; and,
WHEREAS, as a result of the damage, a claim was filed with Texas Municipal
League Intergovernmental Risk Pool (TML-IRP); and,
WHEREAS, TML-IRP has offered to settle the claim for $22,803.00 less the
physical damage deductible amount of $2,500.00, making the final settlement offer
$20,303.00, which is considered a fair and reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR, TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to execute settlement in the
amount of $22,803.00, less the automobile physical damage deductible amount of
$2,500.00, making the final settlement $20,303.00, which is considered a fair and
reasonable settlement as delineated in "Exhibit A".
