RE: PR 22082—Approval of Change Order 1 for Pioneer Park Lift Station
Introduction:
The intent of this Agenda Item is to seek City Council's approval of Change Order 1 for the
Rehabilitation Project at the Pioneer Park Lift Station. In April of 2021, the Council passed
Resolution No. 21-133, awarding the Rehabilitation of the Pioneer Park Lift Station contract to
BDS Constructors, LLC dba MK Constructors of Vidor, Texas. The project engineer is
Arceneaux, Wilson, & Cole. Change Order 1 is a non-monetary Change Order extending the
contract time for sixty (60) days due to shipping delays by the equipment supplier for the
project's submersible pumps.
Background:

Texas. The project engineer is Arceneaux, Wilson, & Cole. Change Order 1 is a non-monetary
Change Order extending the contract time for sixty (60) days due to shipping delays by the
equipment supplier for the project's submersible pumps.
Budget Impact:
No impact.
Recommendation:
It is recommended that City Council adopt Proposed Resolution No. 22082, which authorizes
the acceptance of Change Order 1 for the Rehabilitation Project at the Pioneer Park Lift Station.

A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE CHANGE ORDER NO. 1 BETWEEN THE
CITY OF PORT ARTHUR AND BDS CONSTRUCTORS,
LLC DBA MK CONSTRUCTORS OF VIDOR, TEXAS,
EXTENDING THE CONTRACT TIME FOR SIXTY (60)
DAYS AT NO ADDITIONAL COSTS, FOR THE PIONEER
PARK LIFT STATION REHABILITATION PROJECT.
WHEREAS, pursuant to Resolution No. 21-133, the City awarded a contract to BDS
Constructors, LLC dba MK Constructors of Vidor, Texas, for the Pioneer Park Lift Station
Rehabilitation Project in the amount of$774,065.00; and,
WHEREAS, the project engineering firm, Arceneaux Wilson & Cole LLC, has
submitted Change Order #1, attached hereto as Exhibit "A", requesting to extend the contract
time by sixty (60) days due to shipping delays by the equipment supplier for the project's
submersible pumps at no additional costs associated.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager of the City of Port Arthur is hereby authorized to execute
Change Order No. 1 submitted by Arceneaux Wilson and Cole on behalf of BDS Constructors.
LLC dba MK Constructors of Vidor, Texas, extending the contract time for an additional sixty
(60) days due to shipping delays by the equipment supplier for the project's submersible pumps
at no additional costs; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

Mr. Stanton:
Attached is Change Order No. 1 for the Pioneer Park Lift Station Rehabilitation
project. This change order is for extending the contract time by sixty (60)
calendar days.
The equipment supplier for the project's submersible pumps has informed the
Contractor of a 6-8 week shipping delay beyond the original anticipated delivery
timeframe. The Contractor has currently completed all the necessary submittal
processes for the project. Considering the nature of this lift station rehabilitation,
all of the proposed piping, electrical, and structure modification construction
activities are directly dependent upon the new pump and associated
appurtenances arrival to the site.
This change order and add 60 Calendar Days to the original contract time. There
are no costs associated with this change order. We recommend that the City of
Port Arthur authorize this change order to the contract as submitted. We have
attached Change Order No. 1 which modifies the contract to reflect this change
for your consideration and action.

RE: Pioneer St. Lift Station Time Suspension
Keith,
We have been notified by the pump suppliers for the Pioneer St lift station about a 6 to 8 week delay
from the original delivery schedule. MK is requesting an 8 week time suspension on the project as
discussed at the pre con meeting. Please consider this suspension immediately with time resuming
on September 29, 2021. Contact me anytime with any questions or concerns you may have. Thank
