ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 78, ARTICLE II, DIVISION
5 OF THE PERSONNEL POLICY OF THE CITY OF PORT ARTHUR AS
IT PERTAINS TO ATTENDANCE AND LEAVE BY ADDING SECTION
78-191 — PROVIDING FOR PAID QUARANTINE LEAVE IN
CONFORMITY WITH (HOUSE BILL 2073) SECTION 180.008 OF
THE TEXAS LOCAL GOVERNMENT FOR DETENTION OFFICERS,
CERTIFIED EMERGENCY MEDICAL TECHNICIANS, FIRE
FIGHTERS AND POLICE OFFICERS
WHEREAS, on June 15, 2021, Governor Abbott signed House Bill 2073, relating
to quarantine leave for fire fighters, peace officers, detention officers, and emergency
medical technicians employed by, appointed by, or elected for a political subdivision
who have been exposed to a "communicable disease". It also allows reimbursement of
certain costs related to quarantine.; and
WHEREAS, the bill requires that a city develop and adopt a policy that it deems
appropriate. It also requires that the leave must be ordered by the employee's
supervisor or the political subdivision's health authority. Leave ordered by other medical
professionals is not included. An employee may be required to provide proof of an
order to quarantine and may be denied paid leave or benefits if the employee fails to
provide proof within a reasonable time; and
WHEREAS, Texas Local Government Code Chapter 180 was amended by adding
Section 180.008. Paid Quarantine Leave for Fire Fighters, Peace Officers, Detention
Officers, and Emergency Medical Technicians; and

WHEREAS, the City Council deems it in the best interest of the City to amend
Chapter 78, Article II, Division 5 of the Personnel Policy of the City of Port Arthur as it
pertains to Attendance and Leave is hereby amended by adding Section 78-191 — "The
City of Port Arthur's Paid Quarantine Leave Policy", attached in substantially the same
for as Exhibit"A".
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Chapter 78, Article II, Division 5 of the Personnel Policy of the
City of Port Arthur as it pertains to Attendance and Leave is hereby amended by adding
Section 78-191 — "The City of Port Arthur's Paid Quarantine Leave Policy". HB 2073
requires that this policy be made effective on June 15, 2021. The policy is in
substantially the same form as attached hereto as Exhibit "A."
Section 3. That this being an ordinance that does not require publication, it
will be effective immediately upon passage.
Section 4. That all ordinances and parts of ordinances in conflict herewith are
herein repealed to the extent of the conflict. The personnel policies to the employees
shall also be amended accordingly.
Section 5. That a copy of the caption of this Ordinance be spread upon the
Minutes of the City Council.
