No. 15049 - A Resolution Awarding a Bid for the Interior Repairs to the Department Club Due to Hurricane Ike to SKR Construction in an Amount Not to Exceed $ 22,626 Recommendation: It is recommended that the City Council approve P. R. No. 15049 which awards a bid for the interior repairs to the Department Club due to Hurricane Ike to SKR Construction in an amount not to exceed $ 22,626. Background: Hurricane made landfall on the Texas Gulf Coast on September 13, 2008 causing widespread damage. The Department Club, 1924 Lakeshore Drive, is located approximate to the seawall; therefore, was. exposed to the full brunt of the storm wind, rain, and surge damages. A section of the building's roof was "peeled back"; thereby, exposing the.its interior to wind and rain damages. The building's interior damage was assessed by one of the City's Housing Inspectors and a scope of work was developed for bid. Although, three- contractors attended the mandatory bid meeting, only one chose to bid. The proposed resolution awards a bid for the interior repair at the Department Club to SKR Construction, a Port Arthur business, and the sole bidder for the project at a not to exceed cost of $ 22,626. PR 15049 BudgetlFiscal Impact The approval of this resolution would authorize expenditure, at a not to exceed cost, of $22,636. Funding through IKEDE 121-2300-901.39-00. The City will seek reimbursement from FEMA and insurance. Staffing Impact: None anticipated Conclusion It is recommended that the City Council approve P.R. No. 15049 01/05/09 ATT Resolution No. A RESOLUTION AWARDING THE BID FOR THE INTERIOR REPAIRS TO THE DEPARTMENT CLUB DUE TO HURRICANE IKE TO SKR CONSTRUCTION IN AN AMOUNT NOT TO EXCEED $ 22,626 Funding: IKEDE 121-2300-901.39-00 WHEREAS, Hurricane Ike made landfall on the Texas Gulf Coast on September 13, 2008; and, WHEREAS, the Department Club, an officially designated historic building, suffered interior damage due to Hurricane Ike's wind removing a section of the building's roof; and, WHEREAS, the City of Port Arthur, pursuant to Resolution No. 08-490, has assumed responsibility for the day-today operation of the Department Club building; and, WHEREAS, SKR Construction, a Port Arthur vendor, was the sole bidder on the interior repairs to the Department Club; and, WHEREAS, the City deems it in the best interest of the community to make necessary repairs to the Department Club to restore it to a state of functional use; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the bid for interior repairs at the Department Club is hereby awarded to SKR Construction at an amount not to exceed $ 22,626. Section 3. No. 15049 01/05/09 ATT APPROVED AS TO AVAILABILITY OF FUNDS: Director of Finance APPROVED FOR ADMINISTRATION: Interim Director of Pazks and Recreation City Manager EXHIBIT GG A ~' 1`~~ AN AGREEMENT FOR REPAIR SERVICES AT THE DEPARTMENT CLUB BETWEEN THE CITY OF PORT ARTHUR AND SHIt CONSTRUCTION THIS AGREEMENT, made this 14~' day of Janu , 2009, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and SKR CONSTRUCTION a corporation herein acting by and through Gloria Sanchez, its president hereinafter called "CONTRACTOR" WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein ,OWNER and CONTRACTOR agree as follows: 1. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle with thirty (30) days written notice. Any terms and conditions stated in original specifications will applyto any extended periods. 2. The Contractor will perform repair services at the Department Club, 1924 Lakeshore Drive, Port Arthur, Texas for the City of Port Arthur as stated in the Contract Documents. 3. During the term of this Contract, the Contractor will furnish at his own expense-all of the materials, supplies; tools, equipment, labor and other services necessary to perform the repairs delineated in the bid specifications. The City may at its own discretion elect to purchase materials if it deems such action in its best interest. 4. CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for a price not to exceed $ 22,626. 5. CONTRACTOR will ensure the Department Club is free of all debris and ready for City use once all repairs aze complete.. The Contractor will commence the work required by the Contract Documents on or after receipt of the "Notice to Proceed". The period for completion of the work specified shall be thirty (30) calendar days from the date the Notice is Proceed is signed; however, this contract shall not exceed the maximum end date specified herein without the written permission of the City. The City may at its discretion grant time extensions to this contract. The City shall not unduly delay the contractor in the completion of his work. The Contractor will obtain the appropriate permit for the work to be done. Said permit shall be at no cost to the contractor. 8. The term "Contract Documents" means and includes the following: 1) Agreement 2) Specifications 3) Bid 4) Notice of Awazd 5) Notice to Proceed 9. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. 10. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in (2 copies) each of which shall be deemed an original on the date first above written. Observe all ordinances and recommendations regarding the safe removal of lead-based paints. 2, Sand and feather all scraped areas until the surface is smooth and flat. 3. Remove all hardware from surface being painted. 4. Caulk around window and door casings as needed using latex acrylic caulk. Spackle over nail heads after countersinking. Sand smooth. 5. All surfaces which have had ariy paint removed, must be primed with a high quality primer. Allow primer to dry properly before applying another coat. Primed areas must be smooth. 6. Prime all bare wood, new surfaces (including glaze compound and caulk), and new exposed suRacesusirig-primers recommended by paint manufacturer. 7. All interior paints shall be applied with brush and/or roller and provide full coverage regardless of the number of coats specified. Poor paint application evidenced by transparent effect, bleeding through, lap marks, paint smeared woodwork and fixtures applied over dirt or foreign material are not acceptable. Spray paint is prohibited. 8. Under no circumstances is interior paint to be applied when the temperature in the room where applied is below 50 degrees Fahrenheit h.Entire site must be neatly maintained during work and thoroughly cleaned upon completion.
