The City Council of the City of Port Arthur met in Regular Session on Tuesday, September 7, 2021 at 9:39 a.m. in the City Council Chamber, City Hall, with the following members present: Mayor Pro Tem Donald Frank, Sr.; Councilmembers Ingrid Holmes, Cal Jones, Thomas Kinlaw, III, Kenneth Marks and Charlotte Moses; City Manager Ron Burton; City Secretary Sherri Bellard; City Attorney Valecia R. Tizenc and Sergeant At Arms Police Chief Tim Duriso. Mayor Thurman Bill Bartie was absent from the Special Meeting. II. ITEM REQUIRING INDIVIDUAL ACTION (1) P.R. No. 22102 — A Resolution Approving Settlement Of Wind Damage Claims In The Amount Of $104,942.08 Made Against Certain Underwriters At Landmark American Insurance Company (Through Agent USI Southwest Inc., El Paso) Due To Hurricane Delta (October 9, 2020) To Various City Properties The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Kinlaw, seconded by Councilmember Jones and carried, Proposed Resolution No. 22102 was adopted becoming Resolution No. 21-368. Voting Yes: Mayor Pro Tem Frank; Councilmembers Holmes, Jones, Kinlaw, Marks and Moses. Voting No: None. The caption of Resolution No. 21-368 reads as follows: RESOLUTION NO. 21-368 A RESOLUTION APPROVING SETTLEMENT OF WIND DAMAGE CLAIMS IN THE AMOUNT OF $104,942.08 MADE AGAINST CERTAIN UNDERWRITERS AT LANDMARK AMERICAN INSURANCE COMPANY (THROUGH AGENT USI SOUTHWEST INC., EL PASO) DUE TO HURRICANE DELTA (OCTOBER 9, 2020) TO VARIOUS CITY PROPERTIES (2) P.R. Upon the motion of Councilmember Marks, seconded by Councilmember Kinlaw and carried, Proposed Resolution No. 22117 was adopted becoming Resolution No. 21-369. Voting Yes: Mayor Pro Tem Frank; Councilmembers Holmes, Jones, Kinlaw, Marks and Moses. Voting No: None. The motion was made by Councilmember Holmes and seconded by Councilmember Moses that Proposed Resolution No. 22129 be adopted. Purchasing Director Clifton Williams appeared before the City Council to answer inquiries regarding the above-mentioned contract. Voting Yes: Mayor Pro Tem Frank; Councilmembers Holmes, Kinlaw, Marks and Moses. Voting No: None. Councilmember Jones abstained from voting on Proposed Resolution No. 22129. Proposed Resolution No. 22129 was adopted becoming Resolution No. 21-370. The caption of Resolution No. 21-370 reads as follows: RESOLUTION NO. 21-370 A RESOLUTION RECONSIDERING PROPOSED RESOLUTION NO. 22103, AUTHORIZING THE CITY MANAGER TO NEGOTIATE A CONTRACT WITH FREESE & NICHOLS, INC. OF PEARLAND, TEXAS, FOR THE CONSTRUCTION PHASE SERVICES OF THE MAIN WASTEWATER City Council Minutes Special Meeting — September 7, 2021 2 TREATMENT PLANT REHABILITATION PROJECT LOCATED AT 6300 PROCTER STREET EXTENSION (REQUESTED BY MAYOR PRO TEM FRANK) III. PUBLIC HEARING - 10:00 AM (1) To Receive And Consider Public Comment(s) For All Interested Citizens With Regard To The City Of Port Arthur's Proposed Tax Rate For The 2021 Tax Year A Tax Rate Of 0.740715 Per $100 Valuation Has Been Proposed By The Governing Body Of City Of Port Arthur PROPOSED TAX RATE $0.740715 per $100 NO-NEW REVENUE TAX RATE $0.705171 per $100 VOTER-APPROVAL TAX RATE $0.740715 per $100 The No-New-Revenue Tax Rate Is The Tax Rate For The 2021 Tax Year That Will Raise The Same Amount Of Property Tax Revenue For City Of Port Arthur From The Same Properties In Both The 2020 Tax Year And The 2021 Tax Year The Voter-Approval Tax Rate Is The Highest Tax Rate That City Of Port Arthur May Adopt Without Holding An Election To Seek Voter Approval Of The Rate The Proposed Tax Rate Is Greater Than The No-New-Revenue Tax Rate. This Means That City Of Port Arthur Is Proposing To Increase Property Taxes For The 2021 Tax Year. The Public Will Also Be Able To View The Public Hearing Via The City's Website At www.portarthurtx.gov The Mayor introduced the above-mentioned Public Hearing at 10:11 a.m. Finance Director Kandy Daniel appeared before the City Council and gave an overview of the proposed tax rate. The Mayor requested to hear from anyone present in the audience who wished to speak regarding the above-mentioned item. No one appeared before the City Council to address the above-mentioned item. Joan Jones, 640 E. 10th Street, appeared before the City Council to discuss the proposed tax rate. Upon the motion of Councilmember Holmes, seconded by Councilmember Marks and carried unanimously, the City Council closed the Public Hearing at 10:31 a.m. IV. FY 2021-2022 BUDGET ACTION ITEM REQUIRED Pursuant To Section 26.06 Of The Texas Tax Code; The Governing Body May Vote On The Proposed Tax Rate At The Public Hearing. If The Governing Body Does Not Vote On The Proposed Tax Rate At The Public Hearing, The Governing Body Shall Announce At The Public Hearing The Date, Time, And Place Of The Meeting At Which It Will Vote On The Proposed Tax Rate. City Council Minutes Special Meeting — September 7, 2021 3 Mayor Pro Tern Frank introduced the following motion: A Motion To Postpone The Vote On The Proposed Tax Rate Until September 14, 2021 At 10:00 A.M. The motion was made by Councilmember Kinlaw, seconded by Councilmember Marks, and carried, the above-mentioned motion carried. The following roll call vote was taken on the motion to adopt the above-mentioned motion: Mayor Pro Tern Frank 'Yes" Councilmember Holmes 'Yes" Councilmember Kinlaw "Yes" Councilmember Marks "Yes" Councilmember Moses "Yes" V. A Workshop Regarding The Proposed Fiscal Year 2021 — 2022 Budget For The City Of Port Arthur Finance Director Kandy Daniel gave a presentation regarding the Proposed Fiscal Year 2021 — 2022 Budget. Upon the motion of Councilmember Moses, seconded by Councilmember Kinlaw and carried unanimously, the City Council recessed their meeting recessed their meeting at 10:43 a.m. and reconvened their meeting at 11:30 a.m. with the following members present: Mayor Pro Tern Frank; Councilmember Holmes, Kinlaw, Marks and Moses; City Manager Burton; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Duriso. Assistant City Manager/Administration Scott Moore and Finance Director Kandy Daniel appeared before the City Council to answer inquires regarding the proposed budget. Purchasing Director Clifton Williams appeared before the City Council to answer inquiries regarding the budget. X. ADJOURNMENT OF MEETING Upon the motion by Councilmember Moses, seconded by Councilmember Kinlaw and carried unanimously, the City Council adjourned their meeting at 12:13 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
