The Planning and Zoning Commission me t in Regular Session on Monday,
June 7, 2021, at 5:30 p.m. by telephonic and videoconference to advance the
public health goal of limiting face-to-face meetings (also called “Social
Distancing) to slow the spread of the Coronavirus (COVID -19). Participants

In accordance with Texas Local Government Code, Section 212.004. Plat Required, the owner of a
tract of land located within the limits or in the extraterritorial jurisdiction of a municipality who
divides the tract in two or more parts to lay out a subdivision of the tract, including an addition to a
municipality, to lay out suburban, building, or other lots, or to lay out streets, alleys, squares, parks,
or other parts of the tract intended to be dedicated to public use or for the use of purchasers or
owners of lots fronting on or adjacent to the streets, alleys, squares, parks, or ot her parts must have
a plat of the subdivision prepared…
(b) To be recorded, the plat must:
(1) describe the subdivision by metes and bounds;
(2) locate the subdivision with respect to a corner of the survey or tract or an
original corner of the original survey of which it is a part; and
(3) state the dimensions of the subdivision and of each street, alley, square, park, or
other part of the tract intended to be dedicated to public use or for the use of purchasers or owners
of lots fronting on or adjacent to the street, alley, square, park, or other part.
(c) The owner or proprietor of the tract or the owner's or proprietor's agent must
acknowledge the plat in the manner required for the acknowledgment of deeds.
(d) The plat must be filed and recorded with the county clerk of the county in which the
tract is located.
(e) The plat is subject to the filing and recording provisions of Section 12.002, Property
Code.

BACKGROUND:
An application was submitted on July 30, 2021, requesting a zoning change from “LC” Light
Commercial to a Planned Development District for retail and/or commercial development. The
applicant has a party interested in purchasing the land for the development of a heavy equipment/tool
rental business that would serve various industries throughout the area.

ANALYSIS:
Any person or corporation having a proprietary interest in any propert y may petition the city council
for a change or amendment to the provisions of this ordinance. The planning and zoning commission
may on its own motion or on request from the city council institute study and proposal for changes
and amendments in the public interest.
The planning and zoning commission shall hold a public hearing on any application for any amendment
or change prior to making its recommendation and report to the city council. When any such
amendment or change relates to a change in classification or boundary of a zoning district, written
notice of public hearing before the planning and zoning commission on the proposed amendment or
change shall be mailed to all owners of real property lying within 200 feet of the property on which
the change is requested. Such notice shall be given not less than ten days before the date set for
hearing by depositing in the mail such notice, properly addressed and postage paid, to each taxpayer
as the ownership appears on the last approved city tax roll. When any such amendment relates to a
change of a zoning regulation or to the text of this ordinance not affecting specific property, notice of
the public hearing of the planning and zoning commission shall be given by publication in a newspaper
of general circulation in the City of Port Arthur without the necessity of notifying property owners by
mail. Such notice shall state the time and place of such hearing and the nature of the subject to be
considered, which time shall not be earlier than ten days from the date of publication.

Public Access can be obtained from West Port Arthur Road.
PUBLIC NOTICE:
Eighteen (18) notices were mailed to adjacent property owners within a 200 ft. Radius and published

PLANNED DEVELOPMENT DISTRICT - 41
SECTION 1: AREA
That the zoning designation of the following described tract of land be and the same
is hereby zoned “PD-41”, Planned Development-40 District under the provisions of Section
19:
2.2983 Acres of Land out of and part of Lot 7 (Tracts 2, 3 and 6), Block 2, and Lots
9 and 10, Block 3, Port Acres Addition, Port Arthur, Jefferson County, Texas.
SECTION 2: PERMITTED USES
Use regulations for the “PD-41”, Planned Development-41 District permits uses as prescribed
in Sections 7 for:
1. All uses permitted in the “LC”, Light Commercial or “R” Retail District.
2. Shall also allow the following uses permitted in Commercial (C) or Heavy
Commercial (HC) zoned districts:
a. Building Material Sales (indoor)
b. Cabinet Shop
c. Commercial truck parking, storage or repair
d. Maintenance and repair service for buildings
e. Heavy Machinery and Tool Shop
f. Wholesale Storage and Sales
SECTION 3: DEVELOPMENT STANDARDS
1. The density, coverage, off-street parking, off-street loading, height, and yards shall
comply with the standards established in the “LC” Light Commercial/”R” Retail District,
for all Light Commercial/Retail uses and in the “HC” Heavy Commercial/“C”
Commercial District for all special heavy commercial/commercial uses, otherwise
authorized herein or on the Comprehensive Site Plan or development plan approved
by the Planning and Zoning Commission. The height standards shall be in compliance
with the Height Regulations for the “LC” Light Commercial/” R” Retail District. Noise
standards shall be those established for Light Commercial/Retail districts.
2. No building, sign, structure or other structural improvement shall be erected nearer
than twenty-five (25) feet to the right-of-way of West Port Arthur Road. Driveways
may be constructed across the land strip created by such setbacks but no portion of
any such driveway which may be parallel to or approximately parallel to any street
right-of-way line nor any off-street parking area adjacent to right-of-way shall be
located nearer than fifteen (15) feet to such right-of-way line; it being the purpose and
intent of this provision to create a minimum fifteen (15) foot strip for lawn, planting and
general landscaping purposes between any building and the street right-of-way and
to permit only the construction of essential driveways and walks crossing such strip.

3. Privacy screening will be required in accordance with applicable sections of Port
Arthur Code of Ordinances.
