A RESOLIITION AS IT PERTAINS TO THE PERMIT APPLICATION OF TRIANGLE WASTE WHEREAS, Triangle Waste filed for a permit application for a metal recycling facility on or about June 3, 2008;- and __:_ WHEREAS, the comments of the Director of Community Services is attached hereto as Exhibit "A", the comments of the Deputy Chief of Police is attached hereto as Exhibit "B", the comments of the Director of Planning is' attached hereto as Exhibit "C", and a letter from the Civil Engineer, Mr. Dillon is attached hereto as Exhibit "D", that the storm water management plan is adequate fore the facility when implemented and effectively enforced; and WHEREAS, the City Council deems~it in the public interest to approve the permit, subject to the conditions as denoted in this Resolution; and WHEREAS, Triangle Waste filed a permit application .for the following vehicles to transport scrap, to wit: • Truck No. T-101.- 2000 Mack, LP # 2BX- 380 • Truck No. T-102 - 2001 Mack, LP # R9S- F91 • Truck No. T-103 - 2001 Mack,. LP # 2CU- 671 • Truck No. T-104 - 2001 Mack., LP # 2CU- 670 • Truck No. R-110 - 2007 Mack, LP # 38N- XPS NOW THEREFORE, BE IT RESOLVED BY THE CITY CODNCIL OF THE CITY OF PORT ARTHUR: .- .-I z.pr15099 + ' Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Triangle Waste is herein. granted a permit or license to operate a metal. recycling facility at 2340 S. Gulfway Drive until 'December 31, 2011, wherein Triangle Waste will be required to file a renewal application. ; Section 3. That this permit or license is granted on the following conditions:' • Triangle Waste shall fully comply, in the operation of the facility,~with Section 22-131 to Section 22-165 of the Code of Ordinances. • Triangle Waste shall build an eight (8) foot screening fence around the entire facility by May 1, 2009. • Triangle Waste will follow the recommendations of Mr. Dillon in the storm water management plan. • That the scrap, used, or obsolete ferrous, or non ferrous material cannot exceed (as stored) the height of the fence. • That_ all materials protruding outside of the facility should be placed inside. Section 4. That a permit or a license is also being approved for the following vehicles., as delineated below: • Truck No. T-101 - 2000 Mack, LP # 2BX-380 • Truck No. T-102 - 2001 Mack, LP # R9S-F91 • :Truck No. T-103 - 2001 Mack, LP # 2CU-671 • Truck No. T-104 - 2001 Mack, LP # 2CU-670 • Truck No. R-110 - 2007 Mack, LP # 38N-XP5 The driver of the transport vehicle shall have the documentation as to where the scrap, used or obsolete ferrous or non-ferrous :.pzisa~~ ~ ~ material, was obtained. The scrap shall be covered by a tarp as to prevent the material from falling out of the vehicle. Section 5. That the effective date of this Resolution shall be February 15, 2009. Section 6. Gulfway Drive I inspected the scrape iron operation for Triangle Waste today.. The facility has a metal fence in the front of the business. It does not encompass the entire facility as required by our new scrape iron ordinance. I am submitting copies of photographs taken today .of that.. fence. The owners will have to complete installation of the required fencing in order to comply wits. our current ordinance. Once that is done they will be `in compliance and therefore qualify for a permit from the City to operate at that site. Clark, Deputy Chief of Police Date: January 22, 2009 Subject: Inspection of Triangle-Waste Solutions Greg Gabriel, Manager Pursuant to Ordinance 07-81, Metal Recycling Facilities, an inspection was performed. One inspection was conducted at the 5300 Block of South Gulfway.. This facility contained certain nonferrous materials. From their appearance these materials were .attained- from industrial sources. The material was categorically separated and placed in rows or piles throughout the property. The property was partially enclosed- by an eight -foot metal fence. The fence covers only the front portion of the property. The sides and back are open. There are materials that protrude above the eight foot height of the fence. Metals also extend beyond the front of the fence to the sides. There were no buildings observed on the property. There is no electrical or water service. connected to the property. The manager maintains several fire extinguishers on the property. A records inspection was conducted at 1000 South Business Park Drive. Documentation appeared in order which included the recording of who the scrap, used and recycled metal was purchased from. Provided also was a list of operational vehicles and related documents. All necessary records, equipment and documents, including application, were-made available for inspection. The manager provided a diagram of the existing gravel yard on State-87 and improvements that are planned. It appears that the business needs to make the following corrections to comply with Ordinance 07-81. • Metals should not protrude above the height of the fence. • The fence should be completed to encompass the .facility. • Materials protruding outside of the facility should. be placed iriside. Background Triangle Vlyaste Solutions is preparing to open a metal recycling facility near Sabine Pass by the inter-coastal bridge. The site is depicted with an "X" in Exhibit "A." The site shown is noted as "I" on the zoning map. This indicates that the use is allowed as industrial. This designation encompasses all uses except residential .zoning. No residences are seen within 1000 feet of the area. In the Zoning Ordinance under Section 17 all :the related regulations as to setbacks, height and screening shall be followed.
