A RESOLUTION APPROVING RMT CHANGE ORDER NO. 1 FOR THE REMEDIATION AT 949 NEDERLAND IN THE AMOUNT OF $ 17,849(LOT 9, BLOCK 492, CITY OF PORT ARTHUR) Account No. 001-1003-512.59-00 M01002 WHEREAS, per Resolution No. 02-208, RMT was authorized to remediate vacant Lot 9, Block 492 located at 939 Nederland Avenue; and WHEREAS, Resolution No. 02-208 approved an estimated $18,950 for the remediation; and WHEREAS, due to additional work that was required at the site due to extra liquid disposal, Change Order No. 1 was submitted, as denoted in Exhibit "A" for an additional $17,849; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Change Order No. i is herein approved as denoted in Exhibit ~A" and the City Manager is herein authorized to execute it. Section 4. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Box 1089 Port Arthur, Texas Date: Project No.: Subject: 2/11/03 50-00647.33 949NederlandAvenue Prepared By: Michael Bohmfalk I have forwarded two copies of the final report documenting the permanent removal from service of the UST and Hydraulic Lift systems at 949 Nederland Avenue under separate cover to Ralph Dunderdale for his review. The TCEQ release determination report (RDR) is provided in Appendix A of the final report. Upon return of the signature pages from Mr. Dunderdale, a copy of the report will be delivered to the Petroleum Storage Tank Division at both the TCEQ Central (Austin) and Region 10 - Beaumont offices. Attached, please find our Change Order No. 1 request for additional costs incurred during the course of the project. The Change Order No. 1 request was withheld until the final report and RDR were complete and submitted. As per your letter dated November 4, 2002 acknowledging receipt of the change order request, please advise when the request will be placed on the council agenda for approval. If appropriate, either Alex Onjanow or I can attend the council meeting should further discussion of the change order request be necessary. Box 1089 Port Arthur, Texas Subject: Change Order for Removal of UST Systems and Hydraulic Lift at 949 Nederland Ave. RMT Project No. 50-00647.33 Dear Mr. Sokolow: As discussed during our most recent telephone conversation, attached is a change order request for additional costs associated with the removal of the underground storage tank systems (USTs) and hydraulic lift formerly located at 949 Nederland Avenue in Port Arthur, Texas. These additional costs were incurred due to the following unforeseen conditions encountered throughout the course of the project: · Water and solids encountered within the USTs which required additional cleaning of the tanks prior to removal and necessitated additional cleanout of the vacuum truck at the disposal facility; · Removal of water from the tankholds during tank removal activities due to rainfall during the tank removal activities; · Removal of water from the tankholds prior to excavation of TPH impacted soils; and, · Excavation, transportation and disposal of TPH impacted soils. A change order request has been attached for your consideration. Also attached, please find a table summarizing the additional costs and copies of the water and soil transportation and disposal manifests.
