ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES
AS IT PERTAINS TO THE CONSUMPTION, SALE, RESALE, DISTRIBUTION,
MANUFACTURE OR STORAGE OF ANY LIQUOR, WINE, BEER OR
ALCOHOLIC BEVERAGE WHATSOEVER WITHIN THE CITY LIMITS OF THE
CITY OF PORT ARTHUR
WHEREAS, Chapter 6 of the Code of Ordinances sets forth all legal requirements
related to the consumption, sale, resale, distribution, manufacture or storage of any liquor,
wine, beer or alcoholic beverage whatsoever within the city limits of the City of Port Arthur;
and,
WHEREAS, the consumption,sale, resale, distribution, manufacture or storage of any
liquor,wine,beer or alcoholic beverage in locations in close proximity to churches, hospitals and
schools are incompatible with the missions of health care, religious observance, and the education
of youth, and
WHEREAS, it is in the best interests of the citizens of Port Arthur to provide more
specificity to the application process to ensure greater accuracy and efficiency in the issuance
of permits.
NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Chapter 6, Section 37 is hereby added to the Code of Ordinances as
follows:
Upon receipt of an application for a permit to engage in sale, resale,
distribution, manufacture or storage of any liquor, wine, beer or alcoholic beverage
whatsoever within the city limits, the City's Building Official shall certify in writing to the City
Secretary the measurements between the addresses for places of business where alcoholic
beverages are proposed to be sold and the following:
1. Churches; and
2. Public hospitals; and
3. Public Schools; and
4. Private Schools.
The measurements will be taken based upon the specifications set forth in Chapter 6-
35 of the Code of Ordinances and 109.53 of the Texas Alcohol and Beverage Code.
Section 3. That a copy of the caption of this Ordinance be spread upon the Minutes
of the City Council.
Section 4. That the ordinance shall be effective immediately.
READ, ADOPTED AND APPROVED on this day of A.D., 2021, at a
Regular Meeting of the City Council of the City of Port Arthur, Texas, by the following vote:
