WATSON, DIRECTOR OF PLANNING PUBLIC HEARING ZONING ORDINANCE AMENDMENT Z02-04 (DAVIDSON) DATE: 02/10/03 REQUEST: The applicant is requesting a Specific Use Permit for a Tavern/Lounge at 625/639/641 Procter Street. BACKGROUND: The applicant proposes to operate several businesses at these locations. He proposes to have entertainment at 625 Procter (Jubilation Station) to start and then at a later date start serving food at this location. At 639 Procter he intends to have pool tables. As this location is near Lamar and would attract college students, he is proposing to not sell alcohol at this location during school hours. A small lounge would be located at 641 Procter. He has purchased several other buildings in the downtown area and proposes to create an area along the lines of Crockett Street in Beaumont. PLANNING AND ZONING COMMISSION RECOMMENDATION: The Planning and Zoning Commission met on Monday, January 6, 2003 and recommended that this request be approved. They felt that the proposed use was appropriate for the downtown area. They fek that redevelopment of the downtown area would be in the entertainment area and that Crockett Street provides a good example of what could be done. They did recommend that no alcohol be sold in the pool hall until after 6:00 p.m. PUBLIC COMMENT: 7 property owners were notified of the proposed zoning change. This planned development allows Light commercial uses by right and Industrial uses by Specific Use Permit. The applicant is proposing to rehab and open the buildings located at 625/639/641 Procter Street. An entertainment center is proposed for 625 Procter (Jubilation Station). A billiard room is proposed for 639 Procter and a location providing for dancing is proposed for 641 Procter. Alcohol would be served at all locations. It has been the staffposition for several years that the downtown area of Port Arthur will never be a retail area as it once was due to its location. It would seem that the area is more suited to uses such as entertainment, museums and the arts. The council has gone so far as to designate this area as an arts and entertainment district. There would also appear to be the probability of some fully enclosed non-intrusive commercial or industrial uses. A previous application for a tavern or lounge use at 625 Procter (Jubilation Station) was denied by City Council. It was not totally clear if this request was denied primarily because of the type of activity proposed or because of the sale of alcohol. It would appear that at some point an overall development plan for the downtown area should be undertaken. This plan could address the questions that have been raised in previous applications and are sure to arise in this one. The proposed uses are entertainment in scope and would therefore fit into what appears to best suited for the downtown area. The problem with zoning is that you cannot zone quality, you can only zone the use and under a Specific Use Permit add rational conditions. You could have two identical businesses and one would present no problem and the other is a continuing problem. Zoning does not differentiate between the two.
