The said at the time that the development had a greater chance of success if it did not need to meet two sets of requirements from different cities. Although no official action has been taken yet on the part of Port Arthur to release this property, the item will be discussed at the Council's Feb. 2°d meeting. The City of Groves replat is arranged in Phases I and II, as is the Port Arthur replat. Whether the Port Arthur City Council agrees to eventually disannexing the area or not, all of the water and sewer utilities for the development will be provided by Groves. RR SURVEY, SECTION N0.273 ABSTRACT N0.315, PORT ARTHUR, JEFFERSON COUN'T'Y, TEXAS DATE: 01/27/09 BACKGROUND: This replat would create Tracts 1 & 2 from a 5.69-acre tract "E" that has been the subject of several previous replats as noted in the property description above. This proposed replat would allow construction of a parsonage on the smaller Tract 2 and allow the church to be included in Tract 1. This proposal also allows for financing sources to separate the church from the proposed parsonage. If in the future it becomes necessary for the parsonage to be deeded back to the church, this replat will allow that to be accomplished in a more simple manner, we have been told. DATE: 01/27/09 BACKGROUND: Camellia Plaza LP developed a tract of land for the construction of commercial development along Texas 73 and West Port Arthur Road. A plat of the development grants the city easements and/or rights-of--way for the water and sewer system utilities. Public Works Director Ross Blackketter said that the: project contractor performed the work in accordance with City standards. The City Council adopted Resolution 08-507 on Dec. 30, 2008 which authorized the city manager to sign the certificate of acceptance for the improvements. Mr. Blackketter added that the streets were not accepted because the developer wishes them to remain private. Under normal conditions, the Planning & Zoning Commission would have approved this final plat before the City accepted the improvements. Since the developer chose not to file a performance bond or to open an escrow account, the improvements had to be accepted before the P&Z Commission could be assured of the project's completion so as to allow the final plat to be filed with the County Clerk's Office.
