RE: Pilot Tire Bounty Program - 3 Month.Period
As you know, thousands of tires are being illegally dumped in Port Arthur
every year. In an effort to enhance City cleanup and revitalization efforts, I
am proposing a payment of $2 per tire for tires taken ~to the landfill.
Payment will be made only to Port Arthur residents with proper
identification. Tires picked up, outside Port Arthur will not be accepted.
- Anyone bringing tires from outside Port Arthur, in an attempt to receive
payment, would be in violation of the Ordinance and would be punishable
by fine not to exceed $2,000.•We would also need other safeguards such
as digital pictures, for five tires or more.

Payment would be made at the landfill in the form of a voucher which
could be redeemed for cash of City Hall. Original vouchers-could also be
mailed to City Hall for payment by check. -
The City has a contract with Liberty Tire Recycling. who -will come to the
landfill and remove tires at a cost of $1.25 for most tires with a higher cost
for larger tires. Tire payments.to used tire shops are a difficult question.
Not including used tire shops could:. possibly result in a less effective
program. Based on this, i would recommend payment to used tire shops.
If 10,000 tires were received through this program, we would pay, $20,000 "
in payments and another $15,000 or so to the tire recycler. How much time
and equipment costs we would save, as a result'of not having to send as
many trucks and employees to pick up tires, would be a_guess but it would
be substantial. I°am hopeful that, if approved, this program would greatly
reduce illegally dumped tires in Port Arthur.
I have been. asked a number of questions involving potential program
abuse. Program-abuse is certainly possible; however, this program is only
scheduled for three months and could be modified or ended prior to three
• months if serious abuse or other problems arise.
If approved, it is recommended that we begin the program February 22ntl,
so procedures can be put in place. ,

AN ORDINANCE AS IT PERTAINS TO A TIRE SOIINTY
PROGRAM (ACCOIINT NO. 403-1271-533.59-00),
WHEREAS, it is deemed in the public interest to have a tire
bounty program wherein the City will buy used and abandoned tires
at $2.00 per tire to be collected only from locations within the
City of Port Arthur, not to exceed $40,000; and
WHEREAS, vouchers will be issued which can be redeemed for
cash at City Hall; and
WHEREAS; thousands 'of tires are dumped illegally in Port
Arthur. every, years and this program could significantly reduce
illegal dumping of tires in the City, as well as saving ,time and
money by not having to send out trucks and employees to .pick up
tires; and
WHEREAS, this would be a three (3 )- month pilot program, -
commencing February 22, 2009 and extending until May 31, 2009; and
WHEREAS, the persons who bring the tires to City designated.
sites will be asked as to• where they obtained the used and
abandoned tires from and to state that the tires were obtained from
only locations within the City of Port Arthur and if they make a
false statement thereof to obtain monies from_the City, they can be
charged accordingly.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COIINCIL OF THE CITY
OF PORT ARTHIIR:

Section 1. That the facts and opinions in the preamble
are true and correct.
Section 2. That the City Manager is authorized to
operate a tire. bounty program from February 22, 2009 to. May 31,
2009, at $2.00 per used and abandoned tire, to be collected only
from locations within the City of Port .Arthur, not to exceed
$40,000.-
Section 3. That this program will not be available to
companies that are in the business of providing new tires for-
people with said tire companies being continued to,be.required to
dispose of the tires that they receive from their customers in
accordance with local and state laws.
3ectioa 4. That the used and abandoned tires-will only
be accepted from Port: Arthur residents.
Section 5. That persons who-deliver the tires will be
required to indicate that they~only,obtained the used and
abandoned tires from location or locations within the City of

Port Arthur. The persons will ,be required to provide a driver's
license or similar identification and sign a statement that the
used and abandoned,tire5 were picked up only from locations in
Port Arthur. ,Also, there will. be 'a limit of 100 tires received
at any one time from one person. If a person makes a false
statement as to the location as to where the tires were obtained,
then said person shall be referred to the District Attorney's
Office for possible

prosecution under Section 32.32 of the Penal Code. `
Section 6. That a copy of the caption. of this Ordinance
be spread upon the Minutes of the City Council..
