RECOMMENDATION:
I recommend that Proposed Resolution No. 12102 be approved, This Resolution amends
an agreement with the Texas Department of Transportation providing operating
assistance funds for Port Arthur Transit.
BACKGROUND:
An agreemem was executed between the City of Port Arthur and TXDOT in July
providing $303,204 in funding to the City of Port Arthur to assist in the operating costs of
Port Arthur Transit. Due to the recent budget d'rfficulties at the State level, they are
propos'mg to reduce the funding in this agreement by $5,921. This reduction would have
been greater had not additional oil overcharge funds been available to offset a portion of
the reduction.
BUDGETARY/FISCAL EFFECT:
A reduction in state funding for transit operating assistance in the amount of $5.921
STAFFING/EMPLOYEE EFFECT:
None

A RESOLUTION AUTHOI~IZING AMENDMENT NO. I TO
GRANT AGREEMEN~f NO. $1320F1020 WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION TO PROVIDE
FOR TRANSIT OPERATING FUNDS
WHEREAS, the City Council of thc City of Port Arthur authorized by Resolution No. 02-218 a
contract with the Texas Department of Transportation for financial assistance for operation of the
Port Arthur Transit System in thc amount of $303,204; and,
WHEREAS, the City of Port Arthur has been notified that this amount has been reduced to
$297,283; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT the City Manager is hereby authorized to execute an amendment to Grant No. 51320F1020
between the State of Texas, acting by and through the Texas Department of Transportation and the
City of Port Arthur for additional financial assistance, a copy of said amendment being attached
hereto as Exhibit "A".
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.

STATE/LOCAL PUBLIC TRANSPORTATION GRANT AGREEMENT
AMENDMENT #1
THIs AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of Transportation,
hereinafter called the "State", and the City of Port Arthur, Texas, hereinafter called the "Recipient".
' WITNESSETH
WHEREAS, the State and the Recipient executed a contract on September 1; 2002 to effectuate their agreement to provide for the
expenditure of funds for the purpose of establishing and maintaining public and mass transportation projects and to administer funds
appropriated for public transportation under Transportation Code, Chapter 456; and,
WHEREAS, it has become necessary to amend that grant agreement;
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto, the State and
the Recipient do agree as follows:
AGREEMENT
Article 1. Description of Amended Items:
The Governor, Lt. Governor, and the Speaker of the House have directed the state to reduce its FY 2003 general revenue by an amount
equal to at least seven percent. In addition, the state has received an additional amount of oil overcharge funds. These two factors
combined result in a net reduction of state funds.
Therefore, Article 3A. page 2, sentence 1 is revised to read "The maximam amount payable under this agreement without modification
is $297,283.00". Exhibit A attached hereto is the revised project budget and shall replace the bndget included with the above-
mentioned Gran~.
All other provisions of the original grant agreement are unchanged and remain in full force and effect.

The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the organization they
represent.
IN WITNESS WHEREOF, THE STATE AND TIlE RECIPIENT have executed duplicate counterparts to effectuate this
