RESOLUTION NO.
A RESOLUTION AS IT PERTAINS TO SETTING PUBLIC.
:HEARINGS AS TO THE DISANNEXATION OF PROPERTY
AS REQUESTED BY THE CITY OF .GROVES
WHEREAS, the City Council has been requested to disannex an
approximately ten (10) undeveloped acre tract, as denoted in
Exhibit "A", attached hereto; and "
WHEREAS, the City of Port Arthur can disannex, per the
procedure denoted in Section 43.142 of the Local Government Code,
and per Article I, Section 6, of the. City Charter; and
WHEREAS, this procedure requires notice and hearings.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts'and~opinions in the preamble
are true and correct. `
Section 2. That a public hearing for the disannexation
will be held on March 24, 2009 at 9:00 a`. m. and on April 7, 2009, at
7:00 p.m. ,
Section 3. That the proposed date of disannexation skiall
be May 19, 2009.
:Section 4. That the City of Groves shall pay for all costs
of advertisement.
Section 5. That a copy of the caption of this Resolution

Dear Mayor Prince,
Thank you for your willingness, 'and that of the Port Arthur City council to' discuss this '
deannexation request from the City of Groves. Please accept this letter as a formal request
to deannex approximately 10 acres of undeveloped property behind and just north of
the Church of Christ and the Time Warner office on Hwy 347. The entire area is right at
19 acres. Two maps are attached showing the current city limits and the foot print of the
proposed apartment complex known as Champions Cove. '
As you can`see the project would be in two separate city jurisdictions if left as is. It is our hope
that you and the city council wilf see fit to deannex the portion of the project that would be in
' Port Arthur and allow the City of Groves to annex this property placing the project in one city's
jurisdiction. If the City of Port Arthur were to grant this request this would allow the City of
Groves total jurisdiction for the project and would leave all of the developed commercial property
within the city limits of Port Arthur.

Being a 9.522 acre tract or pazcei of land delineating the limits of the City of Port Arthur, Texas
out of a portion of Lot 1, all of Lot 2 and a portion of hots 3, 4, 5, 6; 7 and 8 of the Kinard
Subdivision, as recorded in Volume 3, Page 184 of the Map or Plat Records, County Clerk's
Office, Jefferson County, Texas and being more particularly described bymetes and bounds as

BEGINNING at a point located on the South line of the limits of the City of Port Arthur and
North line of the limits of the City of Groves, this point mazks the Southeast comer of said Lot 1
and the Southeast corner of the herein described tract of land, said point also being located on the
