No'. 5982 .02/10/09 dl ORDINANCE NO. AN ORDINANCE. DESIGNATING THE ASSISTANT CITY MANAGERS AS ACTING CITY MANAGER IN CASE OF THE ABSENCE OR DISABILITY OF THE CITY MANAGER; OUTLINING THE' AUTHORITY OF THE .ACTING CITY MANAGER; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND. PROVIDING-FOR AN EFFECTIVE .DATE WHEREAS, under Article V, Section 1, of the City Charter, the t' City Council is•required to designate some qualified person to perform the duties of the office to be-known as the Acting City Manager who shall serve in ,case of the absence or disability of the City Manager; and WHEREAS, the City Council of the City of Port Arthur, Texas, deems it both proper and, prudent to make such a designation in order to preclude possible problems should the City Manager be absent or become disabled in the future; and WHEREAS, the City `Council has determined that the Assistant City Manager/Administration and Assistant City Manager/Operations are both qualified persons to perform the duties of the office to be .known as the Acting City Manager. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: , Section 1. That .the ;Assistant City Manager/Administration and the Assistant City Manager/Operations shall be designated to perform the duties of the office to be known as the Acting City Manager under the terms and conditions as more fully hereinafter set out. ~ ~ .. ... Section 2. That the Acting City Managers shall have all the __~ t - powers and duties of the City Manager except they may not remove a City officer without the approval of, the City Council. ..___ Section 3. .That in case of the actual or anticipated absence or disability ,of the City Manager, the City Manager may designate at his sole option the Assistant City Manager/Administration or the Assistant City Manager/Operations to hold the office of Acting City Manager. during his, the City Manager's, actual absence or disability.. This designation shall be made by filing the same in writing with the City Secretary and to the extent practical and feasible notifying the members of the~City Council. Section 4. That if, for any reason, the City Manager is unable to make such a designation, the Mayor, or in her absence or incapacity, the.Mayor Pro Tem, shall designate the Assistant City Manager/Administration or Assistant City Manager/Operations as Acting City Manager in .accordance with the provisions hereof, provided that, such designation bysthe Mayor or Mayor Pro Tem shall be effective only until such time as the City. Council shall designate the same or another person to the office of Acting City Manager. 1 Section 5. That all ordinances and/or resolutions or parts of ordinances and/or resolutions in conflict herewith are repealed to the extent, of such conflict only. Section 6. 'That this. being an ordinance. not requiring publication, it shall be in force and effective immediately upon its passage by the City Council of the City of Port Arthur, Texas. Section 7. That,a copy of. the caption of this Ordinance be spread upon the Minutes of the City Council.` REAP, ADOPTED AND APPROVED on this day of A.
