A RESOLUTION AS TT PERTAINS TO ENTERING YNTO
A RENTAL LICENSE AND SERVICES. AGREEMENT '
WITH HART INTERCIVIC FOR THE MAY 2009
GENERAL AND SPECIAL ELECTIONS
WHEREAS, The City of;Port Arthur will conduct the May 9, 2009 General and
Special Elections; and
WHEREAS, there is a need to obtain the electronic voting machines, equipment
and supplies, which are necessary to conduct the General Election; and
WHEREAS, Hart Intercivic has submitted a lease agreement, attached hereto as
Exhibit "A", for. providing election equipment and services not to exceed the amount of
$40,000.00; and
WHEREAS, the agreement includes equipment, programming of electronic
voting machines, printing paper ballots, election ofFcial training,. equipment support,
and tabulation services at Central Counting Station for the. Early Voting and Election Day
polling sites (a listing. of all of the voting locations is attached hereto as Exhibit "B'~.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCYL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section i. That the facts and opinions in the- preamble are true and correct.
Section 2. That the City Manager is herein authorized to enter into a Lease
and Rental Agreement with Hart Intercivic for the May 9, 2009 General and Special

Elections, in substantially the same form attached hereto as Exhibit A
Section 3. That the City Attorney shall prepare and file the necessary
submission to the Justice Department. as required under Section 5 of the Voting Rights
Act.
Section 4. That a copy.of the. caption of this Resolution be spread upon the
Minutes of the City Council.

Hart will provide election definNOn, programming and autlio recording services in English and Spanish far up to ten
contests, HAVA compliant equipment for seven EV antl ten Eday polling places (a total of 50 DRE voting machines as
requested), on site training for staff and poll workers, on site IAT support, EV antl Eday kits and seals, Help Desk
support, [ahulation and reporting support, and badkup and archive services.
The City of Port Arthuragrees to return the lease equipment to Hart within 30 days of the election on May 9, 2009.
Prices are effective for 30 days from date of agreement

Early voting by personal appearance will be conducted each weekday at the following locations
between the hours of 8:00 a.m. and 5:00 p.m. beginning on April 2Z, 2009 and ending on May 5, 2009:
