Proposed Resolution 12110
City Council authorized an addendum to the audit contract with Gayle W. Botley and Associates to address
concerns of possible conflicts of interest and noncompliance with grant contracts. The addendum provided
funding in the amount of $45,000. On January 21, 2003, the Council approved Resolution 03-025 which
increased ftmding for this audit to $57,000.
The auditor has incurred time and costs of $63,103 as of February 28, 2003. This resolution provides
$16,000 in additional funding, for a total authorization of $73,000.

A RESOLUTION APPROVING ADDITIONAL FUNDING
FOR THE COMPLIANCE AUDIT BEING PERFORMED BY
GAYLE W. BOTLEY & ASSOCIATES AS APPROVED BY
CITY COUNCIL RESOLUTION 02-317
WHEREAS, the City and Gayle W. Botley & Associates entered into a Professional Services
Contract for an audit, signed on June 7, 2002 and approved per Resolution No. 02-162,
WHEREAS, the City Council approved an addendum for a compliance audit per Resolution
02-317 as to address concerns of possible conflicts of interest and possible noncompliance by companies
who received loans or grants from the Port Arthur Section 4A Economic Development Corporation; and
WHEREAS, Section 4 of Resolution 02-317 reads as follows:
"The hourly rates of Gayle W. Botley & Associates will be as delineated in Exhibit "B" with an estimated
additional cost not to exceed $45,000, before returning to Council for additional authorization if needed."
WHEREAS, the City council approved $12,000 additional funding for this contract under
Resolution 03-25;
WHEREAS, the estimated cost is now expected to exceed $57,000.
NOW THEREFORE~ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are tree and correct.
Section 2. That the authorized cost is hereby increased $16,000 to $73,000 before returning to
Council for additional authorization if needed.
Section 3. That the Economic Development Corporation is herein requested to immediately pay
and reimburse the additional costs of the audit as they are approved by the Director of Finance.
Section 4. That a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
READ, ADOPTED, AND APPROVED, this day of March, 2003, AD, at a Regular
Meeting of the City Council of the City of Port Arthur, Texas by the following vote:
