Fitzgibbons, City Manager FROM: Lisa Colten, Safety & Risk Management Coordinator DATE: March 16, 2009 SUBJECT: A Resolution Approving a Property Damage Settlement in the Amount of $13,251.76 for Property Damage to the City of Port Arthur Traffic Control Cabinet COMMENTS RECOMMENDATION: I recommend approval of Proposed Resolution No. 15160 authorizing the property damage settlement made against Juan Santiago Ortiz and Bristol West Insurance Group for damage sustained to the City of Port Arthur traffic control cabinet located at the intersection of Hwy. 87 and Hwy. 347. The amount of the proposed settlement is $13,251.76. The proposed settlement amount represents the full replacement cost; therefore, this is considered a fair and reasonable settlement. BACKGROUND: On September 23, 2008, a vehicle driven by Mr. Juan Santiago Ortiz struck a City of Port Arthur traffic control cabinet at the intersection of Hwy. 87 and Hwy. 347, causing extensive damages. The investigation revealed that the driver was responsible for the accident, so a property damage claim was made against his insurer, Bristol West Insurance Group. Bristol West Insurance Group has offered the City $13,251.76 to settle this claim based on all known costs. BUDGETARYlFISCAL EFFECT: The funds received will be deposited in the account recommended by the Finance Director STAFFING/EMPLOYEE EFFECT: No effect on staffing levels: SUMMARY: I recommend approval of Proposed Resolution No. 15160 authorizing the property damage settlement made against Juan Santiago Ortiz and Bristol West Insurance Group for damage sustained to the City of Port Arthur traffic control cabinet located at the intersection of Hwy. 87 and Hwy. 347. A RESOLUTION AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EXECUTE SETTLEMENT OF THE PROPERTY DAMAGE CLAIM IN THE AMOUNT OF $13,251.76 MADE AGAINST JUAN SANTIAGO ORTIZ AND BRISTOL WEST INSURANCE GROUP WHEREAS, on September 23, 2008, a vehicle driven by Mr. Juan Santiago Ortiz struck a City of Port Arthur traffic control cabinet at the intersection of Hwy. 87 and Hwy. 347, causing extensive damages; and, WHEREAS, as a result of said collision, the City of Port Arthur filed a claim for property damage against Bristol West Insurance Group for that $13,251P76 is a fairoandreason'able settlement amount for WHEREAS, it has been determined the damage sustained. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinion in the preamble of this resolution are true and correct. Section 2. That the City Manager is hereby authorized to do all things necessary to accept $13,251.76 from Bristol West Insurance Group in settlement of the City's property damage claim. Section 3. That a copy of this Resolution be spread upon the minutes of the City Council.
