(Boardwalk Extension) Project

RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 15153, authorizing the
acceptance of a reimbursement from TxDOT for $72,509.30 and closing the Pedestrian
Trail (Boardwalk Extension) project.
BACKGROUND:
In 2002, the City of Port Arthur entered into an agreement with TxDOT for the construction
of the Pedestrian Trail (Boardwalk Extension) project. The project has finally been
completed and is in compliance with TxDOT standards and the Texas Department of
Licensing and Regulation requirements for ADA access. In the final accounting, the City's
contribution exceeded our required local match by $72,509.30.
BUDGETARY/FISCAL EFFECT:
The City is being reimbursed $72,509.30.
EMPLOYEE/STAFF EFFECT:
None.
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 15153, authorizing the
acceptance of a reimbursement from TxDOT for $72,509.30 and closing the Pedestrian
Trail (Boardwalk Extension) project.

HAND DELIVERED
Final inspection by TxDOT and the Texas Department of Licensing and Regu]ation (TDLR) was
made for the above referenced project earlier this year. The project was accepted by TxDOT in
February, 2008, pending TDLR approval. TDLR approval was received in June 2008. Please
find enclosed a final statement of cost for the above referenced project along with a check for
funds totaling $72,509.30 due the City.
Based on the project plan set developed by the City's consultant, the boardwalk extension is
constructed with treated timber lumber. For the safety of the users of this facility it is highly
recommended that at a minimum this surface lumber be reapplied with a penetrating coating
(stain or sealer) annually. If you have any questions, do not hesitate to call.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT A
REIMBURSEMENT IN THE AMOUNT OF $72,509.30 FROM THE
TEXAS DEPARTMENT OF TRANSPORTATION FOR THE
PEDESTRIAN TRAIL (BOARDWALK EXTENSION) PROJECT AND
CLOSING THE PROJECT.
WHEREAS, pursuant to Resolution No. 02-276 and amended pursuant to
Resolution No. 05-125, the City entered into an Advance Funding Agreement with the
State of Texas for Statewide Transportation Enhancement Program funds for the
Pedestrian Trail (Boardwalk Extension); and,
WHEREAS, the project has been completed to the satisfaction of all State
agencies and the City of Port Arthur; and,
WHEREAS, the City has previously made payments that, in the final accounting,
exceeded the local share by the amount of $72,509.30; and,
WHEREAS, accepting a reimbursement payment for the City portion in the
amount of $72,509.30 and closing the project is herein deemed an appropriate action;
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, acceptance of the payment from the Texas Department of Transportation
in the amount of $72,509.30 is herein approved; and,
THAT, the Pedestrian Trail (Boardwalk Extension) project is hereby closed; and,

the City Council.
