AN ORDINANCE AUTHORIZING THE CITY MANAGER AND CITY ATTORNEY TO TRANSFER LAND (PARCELS 2.1 AND 2.3 OF BLOCK 152) TO THE CITY OF PORT ARTHUR SECTION 4A ECONOMIC DEVELOPMENT CORPORATION WHEREAS, the City deeded Tract 2.1 and 2.3 to the City of Port Arthur Section 4A Economic Development Corporation, as delineated in Exhibit "A" for the Tres Cabelleros project; and WHEREAS, Tres Cabelleros project was not completed and the deed had a reverter clause; and WHEREAS, the City Council desires to again deed the property located at Urban Renewal Agency Disposal Tract 2.1, being 62,858 square feet of land out of Block 152, Mabry Addition, and the property located at Urban Renewal Agency Disposal Tract 2.3, being 37,513 square feet of land out of Block 152, Mabry Addition, to the City of Port Arthur Type A Economic Development Corporation; and WHEREAS, this conveyance will comply with Section 5.022 Property Code; and WHEREAS, the consideration for the transfer will be the creation of jobs. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager and the City Attorney are z.po5990 herein authorized to execute a deed, in substantially the same form as attached hereto as Exhibit "B", as to transfer this vacant land to the City of Port Arthur Section 4A Economic Development Corporation. Section 3. That the City finds that the transfer of this property to the City of Port Arthur Section 4A Economic Development Corporation will primarily promote a public service of the City. Section 4. That the ownership of the property will revert to the City if it is not used for a public service. Section 5. That the City of Port Arthur Section 4A Economic Development Corporation shall sign this Ordinance agreeing to the terms hereof. Section 6. That this Ordinance shall take effect immediately from and after its passage. Section 7. That a copy of this Ordinance shall be spread upon the Minutes of the City Council.
