R. # 15165-Repairs to the Concession Stands at Adams Park (3401 60"' Street) COMMENTS RECOMMENDATION: It is recommended that the City Council approve Proposed Resolution No. 15165, authorizing payment for the repairs to the concession stands at Adams Park to JLaday Construction in an amount not to exceed $ 7,885.00. BACKGROUND: Hurricane Ike made landfall on the Texas Gulf Coast on September 13, 2008 and damaged several park buildings in SSGT Lucian Adams Park (3401 60`" Street). The Port Arthur Pony League uses both Roy O'Neal and Dr. U.G. Gibson fields for league play. After reviewing the quotes for the damage to both field concession stands, Pepper's Contractors was deemed the lowest and most responsive bidder. Unfortunately, Mr. Wallace Lyons, owner and principal of Pepper's Contractor, has died suddenly. In as much as Pepper's Contractors, the lowest and most responsive bidder, will be unable to fulfill their obligation due to the death of its principal, the award of the bid goes to the next most responsible bidder, JLaday Construction of Port Arthur, Texas. BUDETARY/FISCAL EFFECT: Funding is available in the amount of $ 7,885.00, Account No. 121-2300-901.39- 00 IKEADM EMPLOYEEISTAFF EFFECT: Acceptance of this recommendation will not effect the staffing levels at this time. That the facts and opinions in the preamble aze true and correct. Section 2. That the bid for repairs to Adams Pazk is hereby awazded to JLaday Construction at an amount not to exceed $ 7,885.00. Section 3. That JLaday Construction will complete all repairs as delineated in his proposals as delineated in Exhibit "A"hereto and will be paid on completion thereof. After reviewing quotes for the damage to both field concession stands, Peppers Contractor was deemed the lowest and most responsive quote. Unfortunately, Mr. Wallace Lyons, owner and principal of Peppers Construction, has died suddenly with only a minimal beginning to the work. Due to the approaching little league season it would be neither prudent nor efficient to wait until the next City Council meeting to award the work to another contractor. A review of the three (3) lowest quotes received [without the inclusion of electrical work which will be done under the City's maintenance contract] is shown on the attached exhibit. In as much as Peppers Contractors, the lowest and most responsive bidder, will be un-able to fulfill their obligation due to the death of its principal, I am requesting permission to authorize the next lowest bidder J. L.
