Contract Amendment beriveen the City of Port Arthur and the
Department of State Health Serv-ices for the WIC Program
RECOMMENDATION:
It is recommended that the City Council approve Proposed Resolution No. 1 ~ 174 to approve an
amendment to the FY 2009 contract between the City of Port Arthur and the Texas Department
of State Health Services for the WIC program.
BACKGROUND:
This is a contract amendment. The WIC program provides supplemental food vouchers and
nutrition education to enhance good health caze at no cost to low-income pregnant and post-
partum women, infants, and children identified to be at nutritional risk. This amendment is to
increase the administrative rate due to WIC implementing new food rules beginning October 1,
2009. The rate is being changed from the current reimbursement rate of $12.10 to $12.38 for
each participant served.
STAFFING/EMPLOYEE EFFECT:
None.
BUDGETARY EFFECT:
The increase in WIC reimbursement will offset the cost of personnel, fringe benefits, travel,
equipment, and supplies for 12 employees.
SUMMARY:
It is recommended that the City Council approve Proposed Resolution No. 15174 to approve an
amendment to the FY 2009 contract beriveen the City of Port Arthur and the Texas Department
of State Health Services for the W'IC program. The administrative reimbursement rates aze being
increased from $12.10 to $12.3 8 for each participant served.

RESOLUTION NO.
A RESOLUTION TO AMEND THE FY 2009 CONTRACT
BETWEEN THE CITY OF PORT ARTHUR AND THE
DEPARTMENT OF STATE HEALTH SERVICES W IC PROGRAM,
ATTACHMENT NO.OOlA
WHEREAS, the contract between the City of Port Arthur and the Department of State
Health Services, provides fmancial assistance to the Port Arthur City Health Department to
supplement the delivery of public health services; and,
WHEREAS, WIC Card Participation, provides for supplemental food instruments,
nutrition education and counseling to enhance good health care at no cost to low-income
pregnant and postpartum women, infants and children identified to be at nutritional risk of which
the grant award is based on monthly client participation; and,
WHEREAS, this Amendment is to increase the administrative rate from $12.10 to
$12.38 due to WIC implementing new food rules beginning October 1, 2009 and agencies being
mandated to conduct additional counseling in the year 2009 to explain changes and train clients
about foods never before allowed.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PORT ARTHUR:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Council of the City of Port Arthur hereby approves the
Amendment to the contract between the City of Port Arthur and the Department of State Health
Services for the WIC Program.

Section 3. That, the City Council deems it is in the best interest of the City to
approve and authorize the City Manager and the Director of the City's Health Department to
execute the Amendment to the contract between the Department of State Health Services and the
City- of Port Arthur, TX to increase the administrative reimbursement rate for the Women's.
Infant and Children (WIC) program as delineated in Exhibit "A".
Section 4. That, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

DEPARTMENT OF STATE HEALTH SERVICES
The Department of State Health Services (DSHS) and CITY OF PORT ARTHUR (Contractor)
agree to amend the Program Attachment # 001 (Program Attachment) to Contract # 2009-
030105 (Contract) in accordance with this Amendment No. OOlA: NSS-WIC LOCAL
AGENCY-NOIMM, effective 04/01/2009
The purpose of this Amendment is to increase the administrative rate due to WIC implementing
new food rules beginning October 1; 2009. Agencies will be mandated to conduct additional
counseling in fiscal year 2009, to explain changes and train clients about foods never before
allowed like fruits and vegetables.
Therefore, DSHS and Contractor agree as follows:
It is mutually agreed by and between the contracting parties to amend the terms and conditions of
Document No. 2009-030105 as written below. All other terms and conditions not hereby
amended are to remain in full force and effect In the event of a conflict between the terms of
this contract and the terms of this Amendment, this Amendment shall control.
