SUBJECT: Proposed Resolution No. 15173
Approval of an Amendment One to the Texas Nurse-Family Partnership
Agreement between the Health and Human Services Commission and the
City of Port Arthur.
RECOMMENDATION
It is recommended that the City Council approve P.R. No. 15173, approving Amendment One to
the Texas Nurse-Family Partnership Agreement between the Health and Human Services
Commission and the City of Port Arthur.
BACKGROUND
The State of Texas, by and through the Texas Health and Human Services Commission (HHSC)
entered in contract with the City of Port Arthur to support the establishment and operation of
local Nurse-Family Partnership (NFP) program to provide educational, health, guidance, and
other resources for low-income, Medicaid eligible, first-time pregnant women during pregnancy,
and during the first t~vo years of their infant's life through visits by highly trained registered
nurses. This program has been working well since October 2008.
Amendment One to the Agreement modifies the following terms to allow for the maximum
provision of program services:
1) Revision of the project managers and other key staff relating to the contract. HHSC has
designated managers and key staff for administrative issues, invoices, purchase vouchers
and reporting deliverables.
2) Revision of the General Payment Terms section of the contract. The August 2009
payment in the amount of $26,919 is being deleted from all of the nine HHSC approved
projects because of a funding shortfall for FY 2009 of $296,118 due to HHSC's inability
to use an anticipated source of funding. Given the delay in implementing the program,
each HHSC program site has sufficient unexpended funds to collectively cover the
shortfall so that it should not negatively impact any of the programs. The City of Port
Arthur's program did not start until late October 2008 and we were not fully staffed until
March 2009; therefore, we will have salary savings to cover operations and staffing
through August 2009.
3) Revision of the HHSC specific client requirements for emolhnent in the Nurse-Family
Partnership program. Enrolled clients must be pregnant Texas residents at or below
185% of the Federal Poverty Level. And, 100% of eligible pregnant clients must be
enrolled in Medicaid within 75 days of enrolling in the NFP program.

BUDGETARY AND FISCAL EFFECT
The City's grant amount is being reduced by $26,919 for August 2009. This will not negatively
effect operations nor staffing since we have salary savings due to the delay in the implementing
the program.
STAFFING EFFECT
None.
SUMMARY
It is recommended that the City Council approve P.R. No. 15173, approving Amendment One to
the Texas Nurse-Family Partnership Agreement between the Health and Human Services
Commission and the City of Port Arthur.

A RESOLUTION TO APPROVE AMENDMENT ONE TO THE TEXAS
NURSE-FAMILY PARTNERSHIP AGREEMENT BETWEEN THE
HEALTH AND HUMAN SERVICES COMMISSION AND THE CITY OF
PORT ARTHUR
WHEREAS, the State of Texas, by and through the Texas Health and Human Services
Commission (HHSC) has entered into a contract with the City of Port Arthur to implement a
local Nurse-Family Partnership (NFP) program to provide educational, health, guidance, and
other resources for low-income, first-time pregnant women during pregnancy, and during the
first two years of their infant's life through visits by highly trained registered nurses; and;
WHEREAS, Amendment One modifies certain terms of the original Agreement to allow
for the maximum provision of program services, as outlined in Articles 1-3 of Amendment One.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Council of the City of Port Arthur hereby approves
Amendment One to the Texas Nurse-Family Partnership Agreement between the Health and
Human Services Commission and the City of Port Arthur.
Section 3. That, the City Council deems it is in the best interest of the City to approve
and authorize the City Manager and the Director of the City's Health Department to execute
Amendment One to the Texas Nurse-Family Partnership Agreement between the Health and
Human Services Commission and the City of Port Arthur as delineated in Exhibit "A"

For
The Texas Nurse-Family Partnership Program
This Amendment One ('`the Amendment") to HHSC Contract No. 529-08-0110-00008 (the "Agreement")
is entered into between the Health and Human Services Commission ("HHSC") an administrative agency
within the executive department of the State of Texas with offices at 4900 North Lamar, Austin, Texas
and The City of Port Arthur. (CONTRACTOR) with offices at 449 Austin Avenue, Port Arthur, Texas,
for the purpose of amending certain key terms of the Original Agreement.
HHSC and the CONTRACTOR may be referred to in this agreement individually as a "Party" or
collectively as the "Parties".
Article 1. Authority and Objectives.
Section I.OI Authority.
The Parties in accordance with Section 206(b) of the Agreement execute this Amendment One.
This modification is also executed in accordance with Article VI of the NFP Agreement document, and
Article 7 of HHSC's General Contract Terms and Conditions, attached as Exhibit C to the NFP
Agreement document.
Section 1.02 Objectives.
HHSC awazded a grant to The City of port Arthur to establish and operate a Texas Nurse-Family
Partnership Program utilizing the program model developed by and in accordance with Nurse Family
Partnership National Service Office. The purpose of this Agreement is to modify certain terms of the
orisina] Agreement to effectuate the maximum provision of program services.
Section 1.03 Modifications to Agreement
The Contract is modified For the following purpose:
• To revise the Project Managers and other Key Staff section of the contract.
• To revise the General Payment Terms section of the contract.
• To revise the HHSC Specific Client Requirements ofthe RFP.

Section 1.04 Effective Date.
This Amendment is effective on the date of execution by the Health and Human Services Commission.
Article 2. Amendment to the Obligations of the Parties
Section 2.01 Modifications.
(1) Amendment of Contract Section 2.08, Proiect Manaeers and other Kev Staff

(2) Amendment of Contract Section 4.02 General Payment Terms
Section 4.02(6) number 12 is deleted and replaced with the following new language:
11. July 2009-payment will be made in the amount of $21,274.70
12. August 2009-payment will be made in the amount of $0
(3) Amendment to RFP Section 2 5 HHSC specific Client Reouirements
Section 2.5, Bullet 5; is deleted in its entirety and replaced with the following new language:
• HHSC requires enrolled clients to be pregnant Texas Residents at or below 185 Federal
Poverty Level.
(4) Amendment to RFP Section 2 6 1 Requirements for Nurse Home Visitors
Section 2.6.1, Paragraph 2, Bullet 4, is deleted in its entirety and replaced with the following
new language:
• Ensure that 100 percent of eligible pregnant clients are enrolled in Medicaid within
75 days of enrolling in the HHSC NFP program:
Article 3. Representations and Agreement of the Parties.
The Parties hereto contract and agree that the terms of the Original Contract shall remain in effect
and continue to govern except to the extent modified by this Amendment.
By signing this Amendment, the Parties hereto expressly understand and agree that the
Amendment is hereby made a part of the original Contract as though it were set out word for word
therein.
The Parties have executed this Amendment in their capacities as stated below with authority to
bind their organizations on the dates set forth by their signatures.
