ARTHUR'S 2009 CONSOLIDATED ANNUAL PLAN. THE CONSOLIDATED
PLAN WILL BE SUBMITTED TO THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT.
WHEREAS, pursuant to the Housing and Urban Development Act of 1974, as amended,
Public Law 93-383, the City will submit to the United States Department of Housing and Urban
Development (HUD) the 35th (2009 Program Yeaz) Consolidated Plan as an application for a grant of
$1,358,218 Community Development Block Grant Funds (CDBG) and a grant for $435,802 in HOME
funds; and,
WHEREAS, the 35th Year Consolidated Plan will include a proposed list of Projects for
2009 and certifications. Included within the Plan is the CDBG budget; and,
WIlEREAS, citizens have been given an opportunity to express their ideas as to projects
which should be included in the 2009 Community Development Block Grant Program at the public heazing.
The public hearings were held on November 24, 2008 and Mazch 30, 2009; and,
WHEREAS, the City Council is required to designate an official to sign all documents in
connection with the Applications and Grant Agreements; Now,
Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
THAT the proposed Consolidated Plan attached hereto as Exhibit "A" for the program year
2009 is hereby approved and adopted by the City Council of Port Arthur to assure compliance with the
Housing and Urban Development Act of 1974, as amended Public Law 93-383.
THAT said Consolidated Plan refers to a grant to be made by the United States Department
of Housing and Urban Development for a Community Development Block Grant of One Million Three
Hundred Fifty Eight Thousand and Two Hundred Eighteen ($1,358,218) and $435,802 in HOME funds for
the 2009 program year.
THAT the City Manager is hereby authorized to execute said documents.
THAT a copy of the caption of this Resolution be spread upon the minutes of the City
Council. .

City of Port Arthur Annual Plan for 2009
Executive Summary
The City of Port Arthur is the lead agency for overseeing the development of the annual Action
Plan and the major public agency responsible for administering programs covered by the
Consolidated Plan.
The Consolidated Plan sets forth the City of Port Arthur's long-term goals for community
development, housing, non-housing and homeless services. Through the collaborative efforts of
the City of Port Arthur, its citizens, nonprofit organizations and service agencies, afive-year
investment plan was derived. The Consolidated Plan establishes the City's goals for providing
decent housing, suitable living environments and expanding economic opportunities for its citizens.
These strategies will be achieved through the allocation of federal funds from the Community
Development Block Grant (CDBG) and Home Investment Partnership (HOME) programs and other
sources received.
ACTION PLAN
The 2009 Consolidated Action Plan summarizes the major housing and community development
needs of low-moderate income households in Port Arthur. The program year begins on June 1 and
ends on May 31. The Department of Housing and Urban Development (HUD) hasn't notified the
City about its 2009 allocation amounts. The 2008 amounts were used as estimations for 2009
allocation:
• Approximately $1,358,218 in Community Development Block Grant (CDBG) funds
• Approximately $ 435,802 in Home Investment Partnership (HOME) funds
Note: A decrease in entitlement funding will result in an equal percentage decrease in CDBG allocations
The City of Port Arthur anticipates generating $181,476 in program income during the 2009
program year. The primary sources of program income are loan repayments through CDBG and
HOME housing programs and demolition repayments. Program income from the HOME program
will fund new home construction and rehabilitationlreconstruction activities. CDBG funds returned
to the loan program are used for future lending.
The Action Plan also serves as the City of Port Arthur's annual application to HUD for these funds.
The objectives and activities funded in this plan also provide a framework for assessing the City's
performance in achieving its overall community development goals.
CITIZEN PARTICIPATION PROCESS
In an effort to increase public participation in the Consolidated Plan process, the City of Port Arthur
conducted two public hearings. The hearings were held at City Hall. City Hall is located in the low-
income downtown area of the City and is adjacent to several other low-income areas. City Hall has
handicapped parking spaces and accommodations for wheelchairs. The public hearing meetings
were held on the following dates:

Monday, March 30, 2009
The purpose of the hearings was to inform the public of the consolidated planning process and to
solicit comments and suggestions on the allocation of funds. Notices for the hearings were
published in the Port Arthur News and direct mailings.

Program Income
The City of Port Arthur expects to receive $181,476 of Program Income from housing activities. The city
will revolve all program income back into the Housing Assistance Program.
PRIORITY Housing Community Development Needs
Texas Department of Housing & Community Affairs, (TDHCAI
Community Development Block Grant (CDBGI Disaster Recovery Program
U.S. Department of Housing and Urban Development approved the State of Texas' Action Plan for
Disaster Recovery that describes the proposed use of U.S. Department of Housing and Urban
Development (HUD) Community Development Block Grant (CDBG) funding associated with the
Department of Defense Appropriations Act, 2006 (Public Law 109-148, approved December 30,
2005) for disaster relief of unmet housing and infrastructure needs resulting from Hurricane Rita in
the most impacted and distressed areas of Texas. Public Law 109-148 (effective December 30,
2005) provided $11.5 billion of supplemental appropriation for the CDBG program for necessary
expenses related to disaster relief, long-term recovery, and restoration of infrastructure in the most
impacted and distressed areas related to the consequences of Humcanes Rita, Katrina and Wilma.
Of this amount, $74,523,000 was specifically allocated to Texas by the Secretary of HUD to
address the consequences of Hurricane Rita, of which a minimum of 55 percent was to be
provided for housing activities. The funds are intended by HUD to be used toward meeting unmet
housing, infrastructure, public service, public facility and business needs in areas of concentrated
distress. The Federal Register (Volume 71, Number 29) includes a definition of "unmet housing
needs" as including, but not being limited to, those of uninsured homeowners whose homes had
major or severe damage; and "concentrated distress" is defined as the total number of housing
units with major or severe housing damage in counties where 50 percent or more of units had more
or severe damage. As provided for in Public Law 109-148, the funds may not be used for activities
reimbursable by or for which funds are made available by FEMA or the Army Corps of Engineers.
The availability of funding was formally announced in the Federal Register (Volume 71, Number
29) on February 13, 2006.
The CDBG Disaster Recovery Program housing allocation must be used solely for expenses
related to disaster relief, long-term recovery, and restoration of housing in the most impacted and
distressed areas, and will:
Meet urgent and unmet housing needs resulting from damage caused by Hurricane
Rita;
Eliminate safety and health hazards resulting from Hurricane Rita in eligible homes
and communities; and
Preserve and improve the community's housing stock.
TDHCA will disallow expenditures if it is determined that funds provided under the CDBG Disaster
Recovery Program were not disaster related or funds allocated duplicate other benefits. No
person, business concern, or other entity may receive CDBG Disaster Recovery funds to assist
with any part of a loss resulting from Hurricane Rita if financial assistance has been received under
any other program or from insurance or any other source. In addition, CDBG Disaster Recovery
funds may not be used for activities reimbursable by or for which funds have been made available
by the Federal Emergency Management Agency or by the Army Corps of Engineers.
The Governor's Office has designated the Texas Department of Housing and Community Affairs
(TDHCA) as the lead agency to administer the CDBG Disaster Recovery Program housing
allocation in the areas impacted by Hurricane Rita.
The office of Rural Community Affairs (ORCA)
was designated as the administering authority for non-housing funds awarded under the CDBG
Disaster Recovery Program. TDHCA has determined that the housing needs of Texas families
affected by Hurricane Rita will be best served by contracting directly with regional Councils of
Governments (COGs). Housing funding under the CDBG Disaster Recovery Program is provided
directly to the following COGS:
South East Texas Regional Planning Commission (SETRPC)
Deep East Texas Council of Governments (DETCOG)
Houston-Galveston Area Council (HGAC)
The three (3) regional COGS are providing assistance for activities directly related to Hurricane
Rita. Types of assistance available to an affected region are determined by the contractual
agreement between the applicable COG and TDHCA, and are limited to:
Demolition;
Emergency repair;
Rehabilitation;
Reconstruction or new construction;
Down payment assistance; or
Acquisition; and
Activities directly related to and/or supporting the above types of assistance.

The City of Port Arthur received $5,565,000 to implement a Community Development Block Grant
(CDBG) Disaster Recovery Program. The CDBG Disaster Recovery Program is designed and the
funds will be used to demolish dilapidated buildings and houses, and conduct feasible rehabilitation
and reconstruction to assist persons and families who are at 80% of the Median Family Area
Income and below with unmet housing needs resulting from Hurricane Rita, eliminate health and
safety hazards resulting from Humcane Rita ineligible homes and communities and preserve and
improve the community's housing stock.
In addition, Hurricane Rita created many dilapidated structures slated for rehabilitation. The
process has been interrupted and aggravated by Hurricane IKE. Efforts are made to rebuild after
the devastation of Hurricane IKE. Protocol for implementation of a program to assist citizens
recover from Hurricane IKE are being established for the following general priorities and will be
used solely for expenses related to disaster relief, long-term recovery, and restoration of housing in
the most impacted and distressed areas, and will:
- Meet urgent and unmet housing needs resulting from damage caused by Hurricane IKE;
- Eliminate safety and health hazards resulting from Hurricane IKE ineligible homes and
communities; and
- Preserve and improve the community's housing stock.

PRIORITY Non-Housing Community Development Needs
The City of Port Arthur has identified the following priority non-housing community development
needs eligible for assistance by CDBG:
A. Elimination of slums and blight and the prevention of blighting influences that adversely affect
the welfare of the community, principally persons of low and moderate income.
B. Elimination of conditions which are detrimental to health, safety and public welfare, through
code enforcement, demolition, residential rehabilitation assistance, and related activities.
C. Conservation and expansion of the City's housing stack in order to provide a decent home and
a suitable living environment for all persons, but principally those of low and moderate-income.
D. Expansion and improvement of the quantity and quality of community services, principally for
persons of low and moderate-income, which are essential for sound community development
and for the development of a viable urban community.
E. Amore rational utilization of land and other natural resources within CDBG eligible areas.
F. The restoration and preservation of properties of special value for historic, architectural, or
esthetic reasons.
G. The alleviation of physical and economic distress through the stimulation of private investment
and community revitalization.

STATEMENT OF SPECIFIC ANNUAL OBJECTIVES
In addition to identifying and prioritizing the City of Port Arthurs housing and community
development needs, the City's FY 2005 - 2009 Consolidated Plan also established a series of
general goals for its housing and community development programs. These goals will remain in
effect until the year 2009 unless revised by City Council with an amendment to the Plan. The goals
are as follows:
Goal 1: Assist low and moderate income families in becoming first-time homeowners.
Goal 2: Assist low income homeowners with rehabilitation of new home construction.
Goal 3: Improve infrastructure in low to moderate-income areas of the City.
Goal 4: Demolish dangerous residential and commercial structures.
Goal 5: Provide effective code compliance.
Goal 6: Target social services to meet needs of low-income households.
Goal 7: Assist the City of Port Arthur Housing Authority, if necessary, with the replacement of
public housing units.
The city's need for housing and the demolition of dangerous structures has increased due to the
damages caused by Hurricane Rita and Hurricane Ike. Many families were forced to relocate to
other cities due to a lack of decent, safe and sanitary housing.

GEOGRAPHIC DISTRIBUTION
The City of Port Arthur will operate its HUD programs in predetermined eligible target areas based
on need. Because low-income, elderly, disabled and special needs homeowners reside throughout
the City, housing assistance is available citywide. Homeless persons and those faced with
potential homelessness, also residing throughout the city, making the need for sheltering and
housing a citywide activity.
Assistance for special needs populations (elderly, disabled, persons with drug/alcohol additions,
persons with HIV/AIDS) is provided citywide as these populations exist throughout the city. Public
Services are also not limited geographically.
The city recognizes the need that exists within the target areas. However, the city reserves the
right to provide assistance to any area where a demonstrated need exists.
HOMELESS AND OTHER SPECIAL POPULATION
The City of Port Arthur will continue to partnership with the Southeast Texas Coalition for the
Homeless. The Coalition is the only regional resource focused on ending homelessness in
Southeast Texas in ten years.
NEEDS OF PUBLIC HOUSING
The Port Arthur Housing Authority is currently building four new affordable housing developments
throughout the city. The new developments include apartments and town homes.
ANTIPOVERTY STRATEGY
In other efforts to raise families out of poverty, Lamar State College -Port Arthur
Scholarship Program continues to assist residents in receiving a college education. The Program
is designed to lower the cost of education making it affordable to anyone desiring to receive either
a vocational/technical certificate or complete the first two years of academic college courses. The
City by way of CDBG funds provides qualified students with tuition, fees, and cost of books.
In order to make affordable housing available to lower to middle income, the City's Housing
Department targets low to moderate-income families for housing assistance.
LEAD-BASED PAINT HAZARDS
The City of Port Arthur has incorporated HUD lead-based paint guidelines into its Housing
Assistance Program Guidelines. According to 24 CFR Part 35, HUD requires that purchasers and
tenants of HUD associated housing constructed prior to 1978 shall be notified: That the property
was constructed prior to 1978; That the property may contain lead-based paint; Of the hazards of
lead-based paint; Of the symptoms and treatment of lead-based paint; Of the precautions to be
taken to avoid lead-based paint poisoning.

MONITORING
The City of Port Arthur shall meet all requirements set forth by the Office of Management and
Budget and shall comply with the requirements and standards of OMB Circular A-87 and A-133,
and with the applicable sections of 24 CFR Part 85. An independent audit is conducted annually to
ensure that CDBG funds are used in accordance with program requirements.
Subrecipient Monitoring
Monitoring subgrantees provides a basis for assessing program operations and identifying
problems. A secondary goal of monitoring is to obtain ongoing data for use in determining program
achievement. Evaluations will summarize monitoring findings, program goals and measure
progress toward those goals during the provision of services. All subgrantees will be monitored at
least once per year.
The City has responsibility for overall CDBG performance and Consolidated Plan compliance,
including the performance of its subgrantees. Clear record keeping requirements for subgrantees
are essential for grant accountability. Responsibility for maintaining many of the records is
assigned to the subrecipient. This includes responsibility for documenting activities with special
requirements, such as necessary determinations and income verification.
The City shall meet all HUD requirements for Consolidated Plan compliance and will review all
relevant funding proposals for consistency with Consolidated Plan strategies.
Sources of Funds
Funds expected to be available: The City will receive its 2009 CDBG allocation of $1,358,218
effective June 1, 2009. The City proposes to generate approximately $181,476 in program income
from demolition and housing loan repayments. These funds are returned to the respective
program.

HOME REQUIREMENTS

PROGRAM SPECIFIC REQUIREMENTS
RESALEIRECAPTURE PROVISIONS
The City of Port Arthur intends to use its Federal HOME allocation for a Owner Occupied Rehabilitation
and Reconstruction of Housing Program and a First Time Homebuyer Assistance Program. The
Owner Occupied Rehabilitation and Reconstruction of Housing Program is to assist low and moderate
income property owners in maintaining their home, eliminate housing code violations and upgrade
neighborhoods. Through this program, the City will help provide decent, safe and sanitary housing far
eligible citizens of the city.
Homes acquired with HOME and CDBG program funds have to satisfy the affordability requirements for a time no
less than the applicable period as indicated the table that follows, beginning after a project has been completed.
The City of Port Arthur will utilize the "Recapture Provisions" to comply with programmatic affordability
requirements.
During the affordability period, the following rules related to the buyers investment, the HOME and CDBG program
funds are applicable:
The dwelling acquired with the HOME subsidy will be the principal residence of the participant and will not be
rented or used for other purposes.
• The participant will not engage the property to obtain a mortgage, gift, sell or exchange the property
without the written consent of the Municipality of the City of Port Arthur, Texas.
The Municipality will inspect the property to assure that the participant is in compliance with these
requirements during the affordability period of the property.
• The non-compliance with the terms and condition mentioned in this provision will obligate the
participant to reimburse the total amount of the subsidy to the Municipality.
• The affordability period of the property will be as follows:

• The participants will pay $5,000 to cover the cost of legal service in case of breaches of any of the terms
and condition of this provision.
• The participant will allow that the CDBG & HOME subsidy constitute a second mortgage to their property.
• Specific documentation required to calculate CDBG & HOME and net proceeds.
o Housing Unit Sale Price (Settlement Statement)
o Homeowner Investments -evidence of down payment, closing costs, and payments to principal,
owner paid closing costs at the point of sale, and any other capital investment to improve the
housing unit.
o Documentation required includes settlement statements for original purchase and sale and all
receipts of capital expenditures.
o Once the documentation is presented, the amount of recapture will be determined on a case-by-
case basis.
In addition to the recapture restrictions to be incorporated in the deed of sale and promissory note, other
provisions will be established to guarantee that the units remain affordable for subsequent homebuyers. These
provisions include the following considerations:
A provision restricting refinancing and subsequent mortgages of the property, without the written consent
of the Municipality. Refnancing will be limited to capital improvements without equity return. This
restriction is necessary, as refinancing with cash return will have the effect of reducing the profit at resale
thus violating the purpose of recapture provisions. In addition, a higher monthly payment after
refinancing could represent a risk of foreclosure due to income adjustments.
A requirement that the property will be used as the principal residence of the homebuyer(s) will not be
leased, converted, sold, donated, and permuted to other such use without written consent of the
Municipality.
In the implementation of the Homeownership Program, the Department will comply and will require recipients to
comply with the provisions of 24 CFR 92.217, Income targeting Homeownership and 24 CFR 92.254,
Qualifications as affordable housing.

HOME Tenant-Based Rental Assistance
The City of Port Arthur doesn't use HOME funds for tenant-based rental assistance.
Forms of Investment
The City of Port Arthur will use its HOME funds only in areas of assistance as described in 24 CFR
92.205.
Affirmative Marketing
The City of Port Arthur homebuyer's program is primarily done on scattered sites. There are no
current plans for projects of five or more units. The City currently advertises in the local newspaper

CERTIFICATIONS
In accordance with the applicable statutes and the regulations governing the consolidated plan
regulations, the jurisdiction certifies that:
Affirmatively further Fair Housing -The jurisdiction will affirmatively further fair housing, which
means it will conduct an analysis of impediments to fair housing choice within the jurisdiction, take
appropriate actions to overcome the effects of any impediments identifed through that analysis,
and maintain records reflecting that analysis and actions in this regard.
Anti•displacementond Relocation Plan -- It will comply with the acquisition and relocation
requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of
1970, as amended, and implementing regulations at 49 CFR 24; and it has in effect and is
following a residential antidisplacement and relocation assistance plan required under section 104
(d) of the Housing and Community Development Act of 1974, as amended, in connection with any
activity assisted with funding under the CDBG or HOME programs.
Drug Free Workplace -• It will or will continue to provide adrug-free workplace by:
1. Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is prohibited
in the grantee's workplace and specifying the actions that will betaken against
employees for violation of such prohibition;
2. Establishing an ongoing drug-free awareness program to inform employees about:
(a) The dangers of drug abuse in the workplace;
(b) The grantee's policy of maintaining adrug-free workplace;
(c) Any available drug counseling, rehabilitation, and employee assistance
programs; and
(d) The penalties that may be imposed upon employees for drug abuse
violations occurring in the workplace;
3. Making it a requirement that each employee to be engaged in the performance of the
grant be given a copy of the statement required by paragraph 1;
4. Notifying the employee in the statement required by paragraph 1 that, as a condition
of employment under the grant, the employee will:

(a) Abide by the terms of the statement; and
(b) Notify the employer in writing of his or her conviction for a violation of a
criminal drug statute occurring in the workplace no later than five calendar
days after such conviction;
Notifying the agency in writing, within ten calendar days after receiving notice under
subparagraph 4(b) from an employee or otherwise receiving actual notice of such
conviction. Employers of convicted employees must provide notice, including position
title, to every grant office or other designee on whose grant activity the convicted
employee was working, unless the Federal agency has designated a central point for
the receipt of such notices. Notice shall include the identification number(s) of each
affected grant;
Taking one of the following actions, within 30 calendar days of receiving notice
under subparagraph 4(b), with respect to any employee who is so convicted -
(a) Taking appropriate personnel action against such an employee, up to and
including termination, consistent with the requirements of the
Rehabilitation Act of 1973, as amended; or
(b) Requiring such employee to participate satisfactorily in a drug abuse
assistance or rehabilitation program approved for such purposes 6y a
Federal, State, or local health, law enforcement, or other appropriate
agency;
7. Making a good faith effort to continue tomaintain adrug-free workplace through
implementation of paragraphs 1, 2, 3, 4, 5 and 6.
Anti-Lobbying -- To the best of the jurisdiction's knowledge and belief:
No Federal appropriated funds have been paid or will be paid, by or on behalf of it,
to any person for influencing, or attempting to influence an office or employee of
any agency, a Member of Congress, an office or employee of Congress, or an
employee of a Member of Congress in connection with the awarding of any
Federal contract, the making of any Federal grant, the making of any Federal loan,
the entering into of any cooperative agreement, and the extension, continuation,
renewal, amendment, or modification of any Federal contract, grant, loan, or
cooperative agreement.
2. If any funds other than Federal appropriated funds have been paid or will be paid to
any person for influencing or attempting to influence an officer or employee of any
agency, a Member of Congress, an officer or employee of Congress, or an employee
of a Member of Congress in connection with this Federal contract, grant, loan, or

The Entitlement Community certifies that
Citizen Participation •- It is full compliance and following a detailed citizen participation
plan that satisfies the requirements of 24 CFR 91.105.
Community Development Plan ••Its consolidated housing and community development plan
identifies community development and housing needs and specifies bath short-term and long-term
community development objectives that provide decent housing, expand economic opportunities
primarily for persons of low and moderate income. (see CFR 24 5702 and CFR 24 part 570.)
following A Plan •• It is following a current consolidated plan (or Comprehensive Housing
Affordability Strategy) that has been approved by HUD.
Use of funds •• It has complied with the following criteria
Maximum Feasible Priority. With respect to activities expected to be assisted with
CDBG funds, it certifies that it has developed its Action Plan so as to give maximum
feasible priority to activities which benefit low and moderate income families or aid
in the prevention or elimination of slums or blight. The Action Plan may also include
activities which the grantee certifies are designed to meet other community
development needs having a particular urgency because existing conditions pose a
serious and immediate threat to the health or welfare of the community, and other
financial resources are not available;
2. Overall Benefit. The aggregate use of CDBG funds including section 108 guaranteed
loans during program yearn(s) 2009, (a period specified by the
grantee consisting of one, two, or three specific consecutive program years), shall
principally benefit person of low and moderate income in a manner that ensures that at
least 70 percent of the amount is expended for activities that benefit such person
during the designated period;
3. Special Assessments. It will not attempt to recover any capital costs of public
improvements assisted with CDBG funds including Section 108 loan guaranteed
funds by assessing any amount against properties owned and occupied by persons of
low and moderate income, including any fee charged or assessment made as a
condition of obtaining access to such public improvements.
However, if CDBG funds are used to pay the proportion of a fee or assessment that
relates to the capital costs of public improvements (assisted in part with CDBG funds)
financed from other revenue sources, an assessment or charge may be made against
the property with respect to the public improvements financed by a source other than
CDBG funds.

entrance to or exit from a facility or location which is the subject of such non-violent civil
rights demonstrations within its jurisdiction;
Compliance With Anti-discrimination laws --The grant will be conducted and administered in
conformity with title VI of the Civil Rights Act of 1964 (42 USC 2000d), the Fair
Housing Act (42 USC 3601-3619), and implementing regulations.
Lead-Based Paint--Its notification, inspection, testing-and abatement procedures concerning

REQUIREMENTS:
A. Lobbyino Certification
This certification is a material representation of fact upon which reliance was placed when this
transaction was made or entered into. Submission of this certification is prerequisite for making or
entering into this transaction imposed by section 1352, title 31, U.S. Code. Any person who fails to
file the required certification shall be subject to a civil penalty of not less the $10,000 and not more
that $100,000 for each such failure.
B. Druo-Free Workplace Certification
1. By signing andlor submitting this application or grant agreement, the grantee is providing
the certification.
2. The certification is a material representation of fact upon which reliance is placed when the
agency awards the grant. If it is later determined that the grantee knowingly rendered a false
certification, or otherwise violates the requirements of the Drug-Free Workplace Act, HUD, in
addition to any other remedies available to the Federal Government, may take action
authorized under the Drug-Free Workplace Act.
3. For grantees other than individuals, Alternate I applies. (This is the information to which
jurisdictions certify).
4. For grantees who are individuals, Alternate II applies. (Not applicable jurisdictions.)
5. Workplace under grants, for grantees other than individuals, need not be identifed on the
