Mr•. Burton informed the commissiion that the replat request had been duly
published ar~d notifications had beE~n mailed to adjacent property owners. No
correspondence from adjacent property owners had been received prior to the
hearing date. He also informed the commission that he and Sr. Planner, Paul
Brown visited the referenced site to ensure familiarity with replat request.
Mr•. Simon moved to close public hearing for R09-06. Ms. LeBlanc seconded the
motion.

VII[. REPORT FROM DIRECTOR - Mr. Burton, informed Commission of the second

Mayor Prince.

BACKGROUND:
The .Planning and Zoning Commission is requested to consider a zoning change from Single-Family
(SF) to Light Commercial (LC) for an area of 6.5~G79 acres located at the southwest corner of the
intersection of F.M. 365 and Jade Avenue in the Port Acres azea of Port Arthur. The property owner,
IV[r. Richard J. Daley, has said that he intends to develop the area with a small grocery/convenience
store and possibly amini-warehouse storage facility, both of which are land uses allowed by right in a
Light Commercial zoned di:~trict.
Public Heanng notices were mailed to three individuals who own property within 200 feet of the tract
ir.~ question. Two of them opposed the zoning change, while one, the applicant, supported the change.
We also received responses from three additional land owners, but our records do not show that the
property they own lies within the 200 feet distance that State Law establishes for notification. The
tl,~ree voiced support for the zoning change.

R.EC'OMMENDATION:
The planning staff has no objections to the approval of this rezoning request. Jade Avenue has been
e:Ktended north. of F.M. 365 into the Port Arthur EDC Business Park, which is located in an Industrial
(1:) zoned district. The area along the north side of F.M. 365 across from Mr. Daley's property is zoned
for Heavy Commercial (HC') use. Since Jade Avenue has been improved, we fully expect that property
along the roadway will attract further commercial as more businesses locate in the EDC Business Park.

BACKGROUND:
The Planning Comnnission is being asked to accept the preliminary site plan for the
commercial development of Lot 5-A of the' Royal Meadows development on Ninth
Avenue and north of Royal Meadows Boulevard. Commercial development in this tract
and the corresponding tract 5-B located south of Royal Meadows Blvd. is intended to
complement the residential development of Royal Meadows Estates already underway. In
the future, the developer is expected to present preliminary plans for the development of
Tract 5-B..

RECOMMENDATION:
Staff recommends that this preliminary site plan be accepted.

plan. We recommend acceptance of this preliminary site plan.
