Attached is P. O. No. 5327 authorizing the conveyance of
property to Beaumont Habitat for Humanity, Inc. in accordance with
the Low and Moderate Income Homebuyers Assistance Program. This
property was originally purchased for $2,224.80 from Helen Haney
for new conssrucslon activities. This proper5y is vacans.
Beaumont Habitat for Humanity, Inc. will be building a house for a
iow uo modera5e income family. This ordinance will be reflected in
the deed.

ORDINANCE NO.
AN ORDINANCE AUTHORIZING A SPECIAL WARRANTY
DEED OF PROPERTY TO BEAUMONT HABITAT FOR
HUMANITY, INC.
WHEREAS, Beaumont Habitat for Humanity, Inc. was chartered as
a Texas non-profit corporation to provide safe, decent and
affordable housing to iow and moderate income families; and,
WHEREAS, Section 272.001(g) of the Local Government Code
provides that a municipality may convey land to an entity for the
development of iow or moderate income housing provided that the
conveyance serves a public purpose.
WHEREAS, the City Council wishes to convey the property
delineated in Exhibit "A~ to Beaumont Habitat for Humainty, Inc.
THAT, this conveyance is hereby authorized and shall be
subject to the following conditions:
1. The sale price shall be One ($1.00) Dollar.
2. Beaumont Habitat for Humanity, Inc. shall hold title to
the lot up to and until the construction of the house. It
shall at this time transfer title to the homebuyer at no
cost.
3. Should the unit not be constructed, property shall revert
back to the City.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are
true and correct.

Section 2. That the City Council herein authorizes the
City Manager to convey the property listed in Exhibit "A" to
Beaumont Habitat for Humanity, Inc. for the purposes as delineated
in the Low and Moderate Income Homebuyers Assistance Program and in
substantially the same form as delineated in Exhibit "B".
Section 3. That a copy of the caption of this Resolution
be spread upon the Minutes of the City Council.

for and in consideration of the sum of Ten and No/100 ($10.00) and other good and valuable
consideration to the undersigned in hand paid by the grantor herein named, the receipt and
sufficiency of which are hereby acknowledged, have GRANTED, SOLD and CONVEYED, and by
these present do GRANT, SELL and CONVEY unto Beaumont Habitat for Humanity, Inc.

oil and gas and/or mineral leases, affecting the above described property, and to all zoning laws
ordinances, rules and regulations of municipal and/or other governmental authorities, but only
to extent that same are in force and effect and relate to the above described property. This
conveyance is also made subject to all state and federal laws and regulations, (including Ordinance

Grantor, for the consideration and subject to the reservation from and exceptions to conveyance
and warranty, grants, sells and conveys to Grantee the property, together with all and singular
the rights and appurtenances thereto in any wise belonging, to have and hold it to Grantee,
Grantee's Heirs, executors, administrators, successors, or assigns forever. Grantor binds Grantor
and Grantee's Heirs, executors, administrators, and successors to warrant and forever defend all
