Commercial) Lot 11, Block 1 of Port Acres Addition - 6555 Jade Avenue, Port
Arthur, Jefferson County, Texas.
REQUEST:
The applicant -Mr. Richard Daley is requesting that a portion the property located on
Lot 11, Block 1 and 12 of Port Acres Addition be rezoned from Single Family
Residential to "LC" Light Commercial for associated commercial uses. The address
is also known as 6555 Jade Avenue. It is located south of FM 365 and west of Jade
Avenue AKA Avenue B (See Exhibit).
BACKGROUND:
The applicant proposes to use the land for a grocery store and storage facility. The
business will require platting if any structure transverse the property lines. The
grocery store will be in accordance with City's Building and Health Codes to obtain a
(CO) certificate of occupancy.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission recommended (6:1) approval of Z09-01 on
April 6, 2009 for a grocery store and a proposed storage facility. The stipulation is for
a neighborhood grocery store and related uses on 6.5479 acres of the 9.396 acres of
land. Resolution 15222 is requesting a public hearing for this case by City Council on
the morning of June 16, 2009

RECOMMENDATION:
The Planning Commission stipulated
- A grocery store or neighborhood retail facility that will generate sales tax as well
as for related uses, but not just a storage facility.

STAFFING/EMPLOYEE EFFECT: None
SUMMARY:
The public hearing will allow for a decision for the owner to operate the proposed businesses
as well as the zoning change approval from "SF" (single -family) to "LC" (light commercial).

A RESOLUTION CALLING FOR A NEW PUBLIC HEARING TO
CONSIDER A ZONING CHANGE "SF" (SINGLE-FAMILY) TO "LC"
(LIGHT COMMERCIAL) FOR A PORTION OF LOT # 11, BLOCKS 1
AND 12, AN ACRE LOT ALSO DESCRIBED AS 6555 JADE AVENUE
(AKA AVENUE B) IN THE PORT ACRES ADDITION, PORT ARTHUR,
JEFFERSON COUNTY, TEXAS
WHEREAS, the owner/applicant - Mr. Richard Daley is requesting that the City of Port Arthur consider
this zoning change for "SF" Single family to "LC" Light Commercial; and,
WHEREAS, Resolution No. 09-146 called for a public hearing on June 2, 2009; and,
WHEREAS, the City Council deemed it necessary to reschedule the public hearing and rescind
Resolution No. 09-146; and,
WHEREAS, in pursuant of Chapter 21 l in the Texas Local Government Code, a public hearing must precede any zoning
change, therefore,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT the Planning Commission approved this case on April 6, 2009.
THAT a public hearing to consider whether to grant this applicant's the zoning change request on a portion of
6555 Jade Avenue (AKA Avenue B) of 6.5479 acres of the 9.396 acres of land labeled Lot I1, Block 1 and 12, of the
Port Acres Addition, in Port Arthur, Jefferson County, Texas as delineated in Exhibit "A" shall be held on June 16,
2009 at 9 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 Fourth Street.
THAT notice of the public hearing shall be published at least fifteen days in the official newspaper of the City before going
to the City Council.
