Background: The City's Landfill requires bulldozers to maintain operations and compliance with the Texas Commission of Environmental Quality (TCEQ) regulations. This bulldozer is used for daily major operations rendering its purchase imperative so the Landfill can remain operational. The purchase of a Caterpillar D5 LGP VPAT Tractor Bulldozer from Mustang CAT for the not to exceed cost of$343,183.98. Budget Impact: Funds are available in the Capital Reserve Equipment fund for The Public Works Solid Waste Equipment account number 625-50-000-8522-00-00-000. Recommendation: It is recommended that the City Council approve the purchases of a Caterpillar D5 LGP VPAT Tractor Bulldozer for the Landfill,from Mustang CAT of Beaumont,Texas, in the not to exceed amount of$343,183.98. A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE A CATERPILLAR D5 LGP VPAT TRACTOR BULLDOZER FROM MUSTANG CAT OF BEAUMONT, TEXAS, THROUGH BUYBOARD CONTRACT NUMBER 597-19, IN A NOT TO EXCEED AMOUNT OF $343,148.98. FUNDS ARE AVAILABLE IN THE CAPITAL RESERVE EQUIPMENT REPLACEMENT PUBLIC WORKS SOLID WASTE EQUIPMENT - ACCOUNT NUMBER 625-50-000-8522-00-00-000. WHEREAS, the City of Port Arthur's Solid Waste Landfill routinely utilizes bulldozers to spread waste in the working face as part of the daily operation; and, WHEREAS, a replacement dozer is needed in order to continue to maintain proper maintenance and function of the City's Landfill; and WHEREAS, a quote was received from Mustang CAT of Beaumont, Texas, via the BuyBoard Cooperative Purchasing Program Contract No. 597-19, for a Caterpillar D5 LGP VPAT Tractor Bulldozer, in the amount of $343,148.98; and, WHEREAS, pursuant to Chapter 271, Subchapter D, of Local Government Code, a city may participate in cooperative purchasing programs established by the State Facilities Commission for the purchase of goods at a price established through purchase contracts of the Commission; and, WHEREAS, per Resolution No. 02-341, the City of Port Arthur entered into an interlocal agreement for cooperative purchasing with the BuyBoard Cooperative Purchasing Program; and, WHEREAS, a copy if the contract pricing sheet for this equipment is attached as hereto as Exhibit "A"; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: PR No. 22200 10/20//2021 meg Page 2 of 3 THAT, the facts and opinions in the preamble are true and correct; and, THAT, the City Council hereby authorizes the City Manager to purchase a D5 LGP VPAT Tractor Bulldozer, from Mustang Cat of Beaumont, Texas, through BuyBoard Cooperative Purchasing Program via Contract No. 597-19, in the not to exceed amount of $343,148.98 as delineated in Exhibit "A"; and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council.
