No. 7024 —Reducing the Speed Limit along SH 73 from Mile Post 20.762 East to Mile Post 24.163 from 75 mph to 70 mph Introduction: Proposed Ordinance No. 7024 seeks City Council's approval to reduce the speed limit along SH 73 from mile post 20.762 east to mile post 24.163 from 75 mph to 70 mph. Background: The City of Port Arthur's landfill, which is located along SH 73, regularly receives vehicles. Upon approaching the Landfill,these vehicles must drastically reduce their speed to safely enter the premises. Because of the accident occurrences in the area,the City's Public Works staff requested that the Texas Department of Transportation (TxDOT) investigate the potential lowering of the speed limit along SH 73 from mile post 20.762 east to mile post 24.163. The traffic survey,which was completed on October 19, 2020, indicated that a speed limit reduction of 5 mph is warranted. The attached speed zone strip map and minute order summarize their study. Budget Impact: There will be no budgetary impact to amend the ordinance. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS,AMENDING CHAPTER 106—TRAFFIC,ARTICLE III— SPECIFIC STREET REGULATIONS,DIVISION 4—SPEED,SECTION 106- 143—SPEED ON STATE AND FEDERAL HIGHWAYS OF THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR, TEXAS, TO ESTABLISH THE MAXIMUM PRIMA FACIE SPEED LIMIT FOR STATE HIGHWAY 73 FROM MILE POST 20.762 EAST TO MILE POST 24.163; AUTHORIZING THE POSTING OF PROPER SIGNS; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A PENALTY OF UP TO FIVE HUNDRED DOLLARS ($500.00)FOR EACH VIOLATION THEREOF;AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. WHEREAS,the Texas Department of Transportation (TxDOT) has made it known to the City of Port Arthur, Texas, that it desires to alter the prima facie speed limit on State Highway 73 from mile post 20.762 east to mile post 24.163; and, WHEREAS, pursuant to Section 545.356 of the Texas Transportation Code, the City Council of the City of Port Arthur may alter the prima facie speed limits with respect to highways or portion thereof with the corporate limits of the City of Port Arthur based upon engineering and traffic studies; and, WHEREAS,the Texas Department of Transportation has provided the City of Port Arthur with a speed zone map with a survey date of October 19,2020,copy attached as Exhibit A,justifying the alteration of the maximum prima facie speed limit to 70 miles per hour; and, P.0.No.7024 12/09/2021 FCR Page 2 of 4 WHEREAS,the Texas Department of Transportation has provided the City of Port Arthur with a Minute Order directing the agency's executive director to implement the order for control and enforcement purposes; now,therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,Chapter 106—Traffic,Article III—Specific Street Regulations,Division 4—Speed, Section 106-143 —Speed on State and Federal Highways, of the Code of Ordinances of the City of Port Arthur, is hereby amended by establishing the following maximum prima facie speed limit: State Highway 73 from mile post 20.762 east to mile post 24.163 to 70 miles per hour; and, THAT, necessary signs for posting the speed limit will be furnished, installed, and maintained by the direction of the Texas Department of Transportation's engineer in charge of the project; and, THAT, it shall be unlawful for a driver of a vehicle to disobey the instructions of a sign placed in accordance with the provisions of this ordinance,unless at the time otherwise directed by a police officer; and, THAT,all ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed;provided,however,that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance; and, THAT, if any provision, section, exception, subsection, paragraph, sentence, clause, or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or set of circumstances and to this end all provisions of this ordinance are declared to be severable; and, P.0.No. 7024 12/09/2021 FCR Page 3 of 4 THAT,any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and No/100 Dollar($1.00) nor more than Five Hundred and No/100 Dollars ($500.00); and, THAT,this ordinance shall take effect from and after ten(10)days from its passage by the City Council. The City Secretary is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Port Arthur at least twice within ten(10)days after passage of this ordinance; and, THAT,the City Secretary shall sign the Certification of Ordinance attached as Exhibit C,and return it to the Texas Department of Transportation along with a copy of this ordinance; and, THAT, a copy of the caption of this ordinance be spread upon the minutes of the City Council. I P.O. 7024 Exhibit B TEXAS TRANSPORTATION COMMISSION VARIOUS Counties MINUTE ORDER Page 1 of I VARIOUS Districts Transportation Code, §545.352 establishes prima facie reasonable and prudent speed limits for various categories of public roads,streets and highways. Transportation Code, §545.353 empowers the Texas Transportation Commission (commission)to alter those prima facie limits on any part of the state highway system as determined from the results of an engineering and traffic investigation conducted according to the procedures adopted by the commission. The Texas Department of Transportation(department) has conducted the prescribed engineering and traffic investigations to determine reasonable and safe prima facie maximum speed limits for those segments of the state highway system shown in Exhibits A and B. Exhibit A lists construction speed zones in effect when signs are displayed within construction projects. The completion and/or acceptance of each project shall cancel the provision of this minute order applying to said project and any remaining construction speed zone signs shall be removed. Exhibit B lists speed zones for sections of highways where engineering and traffic investigations justify the need to alter the speeds. It has also been determined that the speed limits on the segments of the state highway system, previously established by the commission by minute order and listed in Exhibit C, are no longer necessary or have been incorporated by the city which has the authority to set the speed limits on these sections of the highway. IT IS THEREFORE ORDERED by the commission that the reasonable and safe prima facie maximum speed limits determined in accordance with the department's "Procedures for Establishing Speed Zones" and shown on the attached Exhibits A and B are declared as tabulated in those exhibits. The executive director is directed to implement this order for control and enforcement purposes by the erection of appropriate signs showing the prima facie maximum speed limits. IT IS FURTHER ORDERED that a provision of any prior order by the commission which is in conflict with a provision of this order is superseded to the extent of that conflict,and that the portions of minute orders establishing speed zones shown on the attached Exhibit C are canceled. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS, AMENDING CHAPTER 106—TRAFFIC,ARTICLE III—SPECIFIC STREET REGULATIONS, DIVISION 4—SPEED,SECTION 106-143—SPEED ON STATE AND FEDERAL HIGHWAYS OF THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR, TEXAS, TO ESTABLISH THE MAXIMUM PRIMA FACIE SPEED LIMIT FOR STATE HIGHWAY 73 FROM MILE POST 20.762 EAST TO MILE POST 24.163;AUTHORIZING THE POSTING OF PROPER SIGNS; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE;PRESCRIBING A PENALTY OF UP TO FIVE HUNDRED DOLLARS($500.00)FOR EACH VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
