The Port Arthur Zoning Board of Adjustment will meet in regular session at 5:30 p.m.,
Thursday, May 14, 2009, in the City Council Chambers on the fifth floor of the City Hall.
The May 14th agenda contains four applications.

Roll Call -Eddie Scaggs, Hoa "Homie" Dinh, Deral Segler, John Clayton were present to
constitute the necessary quorum. Staff Members present: Planning Director Colleen
Russell
II. Minutes -July 17, 2008 -Regular Meeting
John Clayton moved to accept the minutes of July 17, 2008 as presented; Mr. Segler seconded the
motion: Vote -All Yeas -- motion passed.
III. B09-01, B09-02 (Public Hearing on each followed by Motion required on each)
A. B09-01 -Dorothy Scott -Lot 12, Block 497, Port Arthur Land Company, A-53400 (1415
Beaumont Avenue) Variance for 20-foot deficit in frontal yard setback and 10-foot
deficit in rear setback - i.e. lot is currently 50 X 70 ft. instead of the required minimum
width of 50X100 ft.
Motion to approve was made by John Clayton; seconded by Deral Segler: Item approved
unanimously.
B. B09-02 -Rauch Ministries -Lot 12, Block 171, Port Arthur Land Company, A-053400 (2649
Procter Street) -Variance for 5-foot deficit in lot width - i.e. lot is 50 feet wide instead
of the required 55-foot lot width.
Motion to approve was made by John Clayton; seconded by Eddie Scaggs: Item
approved unanimously.
lV. Report from Director
Ms. Russell explained some of the requirements of the new commissioner positions. She added,
the next meeting will consist of the appointment of a chairman for the Zoning Board.

BACKGROUND:
The Board of Adjustment is being asked to consider a variance for the following
lot(s)/tract(s) in the City of Port Arthur, Jefferson County, Texas.
VARIANCES WILL BE ON THE FOLLOWING LOT:

This site is located north of 12`" Street and east of Galveston Avenue. It is also known as
Lot 7, Block 288, A-053400 from the Port Arthur Land Company, Port Arthur, Tai 77640-
5677. The zoning is " 2F" Two-Family houeing or duplex. Notices were sent out in compliance
with the Texas Local Government Code Section 211 as well as the publication being done
on Apri127`", for the May 14`" meeting more than 15 days prior to the public hearing
Applicant-Linda Barnes (on behalf of Parente) Owner- lY/ilmer and Ruth Brasreaux
RECOMMENDATION:
Staff has no objections to this request due to the hardship of the couple not being able to
afford more land, yet wishing to have the same number of bedrooms as before inline with
City Codes. Four bedrooms and two bathrooms are to be built to Code that is an expansion
of previous house. The adjacent property owners do not desire to sell and this is a corner lot.
Un-utilized space with old sheds and a garage will be used to the fill. The lot coverage is
about 20% less the 40 maximum.
BUDGETARY/FISCAL EFFECT:
None

SUMMARY:
The Zoning Board of Adjustment is requested to reduce the 5 foot set back on the Galveston
side. The City requests no fencing, shrubbery or trees to cause visibility problems. Hedges
shall be 2 feet or less. Other lots with similar situations will not meet the Code due to
insufficient side setbacks and will not conform to the Subdivision/ Zoning Ordinances.
Nevertheless, a legal request is being made prior to the redevelopment of the lot with a four
bedroom, two bathroom house.

RECOMMENDATION:
Staff has no objections to this request due to the hardship of the family not being able to
