Funding

RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 15275, rescinding
Resolution 08-480 and authorizing applying to the Texas Water Development Board
(TWDB) for funding for water and sanitary sewer projects.
BACKGROUND:
The Council previously approved Resolution 08-480 which authorized applying to the TWDB
under the Economically Distressed Areas Program (EDAP) to provide funding for water and
sanitary sewer projects for $500,000 for planning, acquisition, and design (PAD). Since
that authorization, the amount needed has been determined to be $649,000. Authorization
by the Council to apply for EDAP funding for the PAD phase for the appropriate amount is a
requirement of the program. Accordingly, this proposed resolution will increase the
amount requested to $700,000. This is recommended by the TWDB to avoid the possibility
of having to authorize another increase.
BUDGETARY/FISCAL EFFECT:
None.
EMPLOYEE/STAFF EFFECT:
None.
SUMMARY
I recommend that the City Council approve Proposed Resolution No. 15275, rescinding
Resolution 08-480 and authorizing applying to the Texas Water Development Board
(TWDB) for funding for water and sanitary sewer projects.

RESOLUTION NO.
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR RESCINDING RESOLUTION 08-480 AND REQUESTING
FINANCIAL ASSISTANCE FROM THE TEXAS WATER
DEVELOPMENT BOARD; AUTHORIZING THE FILING OF AN
APPLICATION FOR ASSISTANCE; AND MAKING CERTAIN
FINDINGS IN CONNECTION THEREWTTH.
WHEREAS, the Council previously approved Resolution 08-480 approving the
filing of an application with the Texas Water Development Board seeking financial
assistance in an amount not to exceed $500,000 to provide for the costs of water and
sewer projects; and,
WHEREAS, the amount to be requested has been determined to exceed the
previously authorized figure, requiring reapproval by the City Council; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, Resolution 08-480 is hereby rescinded in its entirety; and,
THAT, an application is hereby approved and authorized to be filed with the
Texas Water Development Board seeking financial assistance in an amount not to
exceed $700,000 to provide for the costs of water and sewer projects; and,
THAT, the City Manager be and is hereby designated the authorized
representative of the City of Port Arthur for purposed of furnishing such information and
executing such documents as may be required in connection with the preparation and
filing of such application for financial assistance and the rules of the Texas Water
Development Board; and,

THAT, the following firms and individuals are authorized and directed to aid and
assist in the preparation and submission of such application and appear on behalf of
and represent the City of Port Arthur before any hearing held by the Texas Water
Development Board on such application, to wit:
Financial Advisor: First Southwest Company
Bond Counsel: Vinson and Elkins
Consultant: Dale Watson
THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.
