RECOMMENDATION:
It is recommended that the City Council approve Proposed Resolution No. 15271 authorizing the
City Manager to execute an agreement with AAR Incorporated of Houston, Texas for asbestos
and mold abatement of Fire Station #2 for a total amount of $11,511. Funds are available in
Project IKEFS2, 121-2300-901.59-00.
BACKGROUND:
Fire Station #2 was damaged by Hurricane Ike, with part of the roof on the south edge of the
building torn off. This has been repaired, but water incursion did occur, and the living quarters
on the south side of the building need to be repaired. The City's consultant, ICU Environmental
Health and Safety assessed the building, prepared specifications for abating the mold and
asbestos, and solicited quotes for the abatement.
Quotes were received as follows:
AAR Incorporated Houston, TX $ 11,511
Brock Services, Ltd. Beaumont, TX $ 15,260
Inland Environments, Ltd. Port Arthur, TX $ 17,880
Our consultant evaluated the quotes and recommended AAR Incorporated.
In addition, the undamaged living quarters on the north side of the building were tested for
mold and found to be good as shown in the attached email.
BUDGETARY/FISCAL EFFECT:
Funds are available in Project IKEFS2, 121-2300-901.59-00.
EMPLOYEE/STAFF EFFECT:
None.
SUMMARY:

Airborne fungal concentration at Firestation No. 2's current
living quarters looks good. See attached results. No elevated fungal spores are present.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH AAR INCORPORATED OF
HOUSTON, TEXAS FOR ASBESTOS AND MOLD ABATEMENT OF
FIRE STATION #2 FOR THE TOTAL AMOUNT OF $11,511;
PRO7 IKEFS2, 121-2300-901.59-00
WHEREAS, Fire Station #2 suffered roof damage from Hurricane Ike; and,
WHEREAS, water intrusion caused damage to an area of the living quarters; and,
WHEREAS, abatement of the resulting mold and existing asbestos is necessary in order
to repair the interior damage; and,
WHEREAS, three (3) quotes were solicited and reviewed by the City's consultant; and,
WHEREAS, AAR Incorporated was the lowest responsible bidder with a total of
$11,511; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the City Council of the City of Port Arthur hereby awards the quote for asbestos
and mold abatement of Fire Station #2 to AAR Incorporated of Houston, Texas; and,
THAT, the City Manager is hereby authorized to execute an agreement with AAR
Incorporated of Houston, Texas (attached as Exhibit "A'~ for asbestos and mold abatement of
Fire Station #2, Project IKEFS2, 121-2300-901.59-00; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

EXHIBIT A
CONSTRUCTION SERVICES AGREEMENT
Asbestos and Mold Abatement of Fire Station #2
THIS AGREEMENT, made this the 19~h day of Mav 2009, by and
between the City of Port Arthur, a municipal corporation organized under the
laws of the State of Texas, hereinafter called "OWNER" or "CITY" and AAR
Incoroorated hereinafter called "CONTRACTOR".
WITNESSED: That for and in consideration of the payment terms, conditions
and agreements set forth herein, OWNER and CONTRACTOR agree as follows:
The Contract shall commence within ten (10) days of the execution of the
Contract by the OWNER. The work to be performed under this Contract
will be completed within 10 calendar days of commencement.
2. The CONTRACTOR will perform the work as delineated in the Scope of
Work and Specifications ~"~~~~--~~ as provided by ICU
Environmental Health and Safety.
3. During the term of this Contract, the Contractor will furnish at his own
expense all of the materials, supplies, tools, equipment, labor and other
services necessary to connection therewith, excepting those supplies
specifically not required of Contractor in the Specifications and Scope of
Work.
The CONTRACTOR agrees to perform all the work described in the specifications
and contract documents and to comply with the terms therein for the total
cost of $11,511
5. The CONTRACTOR will commence the work required by the Contract
Documents upon receipt of a Notice to Proceed.
6. The term "Contract Documents" means and includes the following:
1) Agreement
3) Addenda
4) General Information
5) Specifications
6) Bid Quote
7) Notice to Proceed

7. This Agreement shall be binding upon all parties hereto and their respective
heirs, executors, administrators, successors and assigns.
8. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be
executed by their duly authorized officials, this Agreement in (2 copies)
each of which shall be deemed an original on the date first above written.

6. Exclusions:
A. P&P Bonds.
B. Any concealed conditions.

asbestos.

F. State of Texas ARU and/or Mold fees.
