RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT WITH CITY FENCE COMPANY
OF PORT ARTHUR,TEXAS FOR THE CONSTRUCTION OF
A COMMERCIAL GRADE CHAIN LINK FENCE IN THE
NOT TO EXCEED AMOUNT OF $30,500.00 PURSUANT TO
CAUSE NO. B-176,606; WILLIAM WORSHAM V. CITY OF
PORT ARTHUR. FUNDING IS AVAILABLE IN GENERAL
LIABILITY FUND-CLAIMS AND SETTLEMENT EXPENSE
ACCOUNT NO. 612-11-025-5416-00-00-000
WHEREAS,on November 9,2021,the City Council passed a motion authorizing the City
Manager and City Attorney to enter into and execute a Full and Final Settlement Agreement in Cause
No. B-176,606; William Worsham v. City of Port Arthur; and
WHEREAS,pursuant to Section 6 of the Settlement Agreement,the City is required,as part
of the settlement, to construct an approximately nine hundred (900) linear foot, six (6) foot tall
commercial grade chain link fence along the outer eastern boundary of Reserve Tract F(also known
as Lots 74-87 of Marina Colony, Section One) or along the right of way of Lakefront Drive; and
WHEREAS, local area contractors were solicited for the proposed project and three (3)
responsive quotes were received with City Fence Company of Port Arthur, Texas submitting the
lowest most responsive quote in the amount of$30,500.00, as delineated in Exhibit"A".
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct.
THAT, the City Council hereby authorizes the City Manager to execute a contract, in
substantially the same form, attached hereto as Exhibit "B", with City Fence Company of Port
Arthur,Texas for the construction of said fence in the total amount not to exceed$30,500.00,with
funding available in General Liability Fund-Claims and Settlement Expense Account No.612-11-
025-5416-00-00-000.

Exhibit "B"
CONTRACT FOR CONSTRUCTION
INSTALLATION OF A COMMERCIAL GRADE CHAIN LINK FENCE
THIS AGREEMENT, made this day of , 2022 by and between the City of
Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter
called "OWNER" or "CITY" and City Fence Company of Port Arthur, Texas, acting by and
through Ron Nguyen herein called "CONTRACTOR".
WITNESSED: That for and in consideration of the payments, terms. conditions, and
agreements set forth herein, OWNER and CONTRACTOR agree as follows:
1. The terms of this Contract shall be for ninety (90) days from date stated in the Notice to
Proceed, unless sooner terminated under the provision hereof. The City can terminate this
contract at its convenience which includes, but not limited to, funding being available in any
budget cycle with thirty(30) days written notice.
2. The Contractor will perform the duties of construction and installation of an approximately
nine hundred (900) linear foot, six (6) foot tall commercial grade chain link fence along the
outer eastern boundary of Reserve Tract F (also known as Lots 74-87 of Marina Colony,
Section One) or along the right of way of Lakefront Drive.
3. During the term of this Contract, the contractor will furnish at his own expense all of the
materials, supplies, tools, equipment, labor and other services necessary to connection
therewith, expecting those supplies specifically not required of Contractor in the
specifications.
4. The Contractor agrees to perform all the work described in this contract and the attached
proposal for a total sum not to exceed $30,500.00.
5. The term"Contract Documents"means and includes the following:
a. Agreement
b. Notice of Award
c. Proposals
d. Notice to Proceed
6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
administrators, successors and assigns.
7. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by
their duly authorized officials,this Agreement in(2 copies)each of which shall be deemed an
original on the date first above written.
