HomeMy WebLinkAboutPR 15272: PAISD - WATER UTILITY EASEMENTSMEMORANDUM CITY OF PORT ARTHUR UTILITY OPERATIONS DEPARTMENT TO: Stephen Fitzgibbons, City Manager FROM: Kelly Eldridge, Director of Utility Operations /~~ V" DATE: May 12, 2009 RE: Proposed Resolution No. 15272 COMMENTS RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 15272 accepting three (3) Water Utility Easements from the PAISD for the purpose of installing, maintaining, operating, and replacing vazious public water/sewer utilities on a portion of their property. BACKGROUND The PAISD is constructing a new Washington Elementary School on Texas Ave. & 14"' Street. Some minor water and sewer construction is necessary to provide service, and will have to be done off of existing City right of way. We require three small easements, one for their water meter & appurtenances, and two for manholes, in order to provide service to this property. These easements are adjacent to the Texas Ave. right-of--way. BUDGET/FISCAL EFFECT The City will install all public water & sewer infrastructure in these easements, with all materials, labor & equipment costs to be paid by the PAISD. STAFFING/EMPLOYEE EFFECT City staff will install the meter and appurtenances in the first easement; and install manholes in the other two easements. SUMMARY I recommend that the City Council approve P.R. No. 15272 accepting three (3) Water Utility Easements. P.R No. 15272 05/12/09 RESOLUTION NO. A RESOLUTION ACCEPTING THREE UTILITY EASEMENTS FROM THE PORT ARTHUR INDEPENDENT SCHOOL DISTRICT FOR THE CONSTRUCTION, INSTALLATION, LAYING, AND MAINTAINING OF WATER AND SEWER UTILITIES IN THE CITY OF PORT ARTHUR WHEREAS, the City Council of the City of Port Arthur deems it appropriate to accept three (3) utility easements from the Port Arthur Independent School District for the construction, installation, laying, and maintenance of water and sewer utilities in the City of Port Arthur under, through, and across portions of property owned by the Port Arthur Independent School District in connection with water and sanitary sewer services of the City of Port Arthur; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager of the City of Port Arthur be and is hereby authorized and instmcted to execute and accept utility easements from the Port Arthur Independent School District for the purpose of constructing, installing, laying and maintaining water or sewer utilities in substantially the same form as described in Attachments "A", "B", and "C" attached and made a part hereof; and, THAT, a certified copy of said easements shall be filed for record in the office ofthe County Clerk of Jefferson County, Texas; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. It is expressly understood and agreed that the City shall have the right to temporary use of such adjacent property to the above designated Easement tracts as is reasonably needed for working room to accomplish the aforesaid purposes of this Easement.
