RECOMMENDATION:
It is recommended that the City Council authorize the Mayor to apply for the Recovery
Act Edward Byrne Memorial Justice Assistance Grant from the Department of Justice in
the amount of $10,000.
BACKGROUND:
On February 17, 2009, President Obama signed into law the Landmark American
Recovery Act of 2009. As one of the many elements, the Recovery Act provides for
grants to assist local law enforcement. The City Manager received notice from the
Department of Justice, Office of Justice Programs of an awazd notice allocating $201,567
to the City of Port Arthur. Due to dispazities, an Interlocal Agreement with the Cities of
Beaumont, Nederland, Groves, Port Neches and Jefferson County was executed with
recommended funding in the amount of $171,332. On May 8, 2009 the Police
Department was notified by the Southeast Texas Regional Planning Commission that
$736,825 in additional funding had been made available to the region and that the City of
Port Arthur was eligible to apply for an additional $10,000 in funding by the Recovery
Act Edward Byme Memorial Justice Assistance Grant.

SUMMARY:
It is recommended that the City Council authorize the Mayor to apply for the Recovery

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE MAYOR TO MAKE
APPLICATION AND RECEIVE ADDITIONAL FUNDING
THROUGH THE RECOVERY ACT: 2009 EDWARD BYRNE
MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM
IN THE AMOUNT OF $10,000.
WHEREAS, the City of Port Arthur has been awarded funding through the
Edwazd Byrne Memorial Justice Assistance Grant (JAG) Program for the past three
years; and
WHEREAS, the funding has been used to upgrade technology through the
purchase of computer hardware, software, and other technology related equipment;
WHEREAS, per Resolution 09-147, the City entered into an Interlocal
Agreement with Jefferson County, the City of Beaumont, the City of Nederland, the City
of Groves, and the City of Port Neches, in order to reallocate Justice Assistance Grant
Funds in the amount of $818,795, with $171,332 funding allocated to the City of Port
Arthur; and
WHEREAS, Southeast Texas Regional Planning Commission has notified the
City that it is eligible for an additional $10,000 in funding through the Recovery Act
Edward Byrne Memorial Justice Assistance Grant; and
WHEREAS, it is deemed in the best interests of the citizens to apply for the
additional funds.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.

Section 2. That the City Council of the City of Port Arthur authorizes the
Mayor to make an electronic application and receive funding through the Recovery
Act:2009 Edward Byme Memorial Justice Assistance Grant (JAG) Program for an
additional $10,000 in grant funds.
Section 3. That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.
