No. 22378 authorizing the City Manager to execute a contract with Construction Managers of Southeast Texas, LLC of Port Arthur, Texas for repairs to the pavilion at Washington Park under the Interlocal Purchasing System (TIPS) Cooperative Contract Number 200201 in an amount not to exceed $54,810.00. Background: On August 27, 2020, Hurricane Laura caused significant damage to the City of Port Arthur. Various parks and facilities were severely affected. Construction Managers of Southeast Texas, LLC of Port Arthur, Texas submitted a quote for repairs to the pavilion at Washington Park. Repairs to this park and facility is necessary in order to provide continued use for the citizens of Port Arthur. Budget Impact: Funding in the amount of$54,810.00 is available for this purpose in the Hurricane Laura Fund Account No. 156-07-015-5312-00-40-000, Project No. LAUR25-GRE-BUM and will be submitted for reimbursement by insurance. Recommendation: It is recommended that the City Council approve P.R.No. 22378 authorizing the City Manager to execute a contract with Construction Managers of Southeast Texas, LLC of Port Arthur, Texas for repairs to the pavilion at Washington Park under the Interlocal Purchasing System (TIPS) Cooperative Contract Number 200201 in an amount not to exceed $54,810.00. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH CONSTRUCTION MANAGERS OF SOUTHEAST TEXAS, LLC OF PORT ARTHUR, TEXAS FOR REPAIRS TO THE PAVILION AT WASHINGTON PARK UNDER THE INTERLOCAL PURCHASING SYSTEM (TIPS) COOPERATIVE UNDER CONTRACT NUMBER 200201 IN THE AMOUNT NOT TO EXCEED $54,810.00. FUNDING AVAILABLE IN HURRICANE LAURA FUND ACCOUNT 156- 07-015-5312-00-40-000, PROJECT LAUR25-GRE-BUM WHEREAS, on August 27, 2020, Hurricane Laura caused significant damages to the City of Port Arthur; and, WHEREAS, various parks and facilities were severely affected by Hurricane Laura; and, WHEREAS, three (3) quotes was received from three (3) companies for pavilion repairs at Washington Park; and, WHEREAS, the quote tabulation is attached hereto and made a part hereof as Exhibit "A"; and WHEREAS, pursuant to Chapter 271, Subchapter D, of the Local Government Code, a city may participate in cooperative purchasing programs established by the State Facilities Commission for the purchase of goods at prices established through purchase contract of the Commission for the purpose off the Commission; and, WHEREAS, per Resolution No. 12-008, the City entered into an Interlocal agreement for the cooperative purchasing with Region VIII Education Service Center for participation in the Interlocal Purchasing System (TIPS); and, WHEREAS, Construction Managers of Southeast Texas, LLC of Port Arthur Texas is an approved vendor through the TIPS Cooperative Purchasing Program under Contract Number 200201; and, P. R.No. 22378 2/03/2022 ca WHEREAS, Construction Managers of Southeast Texas, LLC has submitted a quote for pavilion repairs to Washington Park in an amount not to exceed $54,810.00 under TIPS contract No. 200201 attached as Exhibit"B". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby authorizes the City Manager to execute a contract, in substantially the same form, attached hereto as Exhibit "C", with Construction Managers of Southeast Texas, LLC of Port Arthur, Texas for repairs to the Pavilion at Washington Park in an amount not to exceed $54,810.00 and will be submitted for reimbursement by insurance. Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Demolish and haul existing roof and insulation to access damaged roof panels: $2,550.00 Furnish, replace and install (3) 24 gauge standing seam roof panels: $2,700.00 Furnish and install insulation(4'x125' roll or 500 sft) under and between $2,250.00 the roof panels. Cost for scope identified above: $7,500.00 After reviewing the existing conditions of the pavilion we are providing the below alternate pricing in order to replace the roof as a whole for consideration: • Remove standing seam roof, insulation,gutters, downspouts & Trim. No. 22378 2/03/2022 ca EXHIBIT "C" CONTRACT FOR PAVILION REPAIRS AT WASHINGTON PARK THIS AGREEMENT, made this day of , 2022 by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and Construction Managers of Southeast Texas, LLC of Port Arthur, Texas hereinafter called"CONTRACTOR". WITNESSED: That for and in consideration of the payments, terms, conditions, and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The terms of this Contract shall be from date stated in the Notice to Proceed, until June 30, 2022 unless sooner terminated under the provision hereof. The City can terminate this contract at its convenience which includes, but not limited to, funding being available in any budget cycle with thirty (30) days written notice. 2. The contractor will perform pavilion repairs to Washington Park in an amount not to exceed $54,810.00 as quoted in Exhibit"B"of the Resolution. 3. During the term of this Contract, the contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, expecting those supplies specifically not required of Contractor in the specifications. 4. The term"Contract Documents"means and includes the following: a. Agreement b. Notice of Award c. Quote (Exhibit`B" of the Resolution) d. Notice to Proceed 5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. 6. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in(2 copies) each of which shall be deemed an original on the date first above written.
