COMMENTS
RECOMMENDATION:
I recommend that the City Council approve Proposed Resolution No. 12160 amending the contract for
engmeenng services for the water line rehabilitation project.
BACKGROUND:
In July, 2001, the City Council awarded a contract to Arceneaux & Gates Consulting Engineers. Inc. for
professional services related ro the waterline replacement project. This resolution will approve an
amendment to the contract for additional professional services for the acquisition of approval to perform
portions o f this project in wetland areas through the Nationwide Permit(s/from the United States Army Corps
of Engineers. The amount of this change is $24.900.00. It should be noted ho;vever, if the United States
Army Corps of Engineers requires an individual permit for this work, an additional increase of $20, 100.00
will be required.
BUDGET/FISCAL EFFECT:
Funds for this amendment are to be made available in account no. 427-1626-532.53-00, Project No. 427002
STAFF/EMPLOYEE EFFECT:

A RESOLUTION AUTHORIZING THE APPROVAL OF A
ADDITIONAL SERVICES AS IT PERTAINS TO THE
CONTRACT FOR PROFESSIONAL SERVICES TO
ARCENEAUX & GATES IN CONNECTION WITH THE
WATER LINE REHABILITIATION PROJECT IN THE
AMOUNT NO'[ TO EXCEED $45,000 (FUND NO. 427-
1626-532.53-00, PROJECT NO. 427002)
WHEREAS. the City Council approved a contract for Professional Services on July
24, 2001, by Resolution No. 01-203 between the City of Port Arthur, Texas and Arceneaux
& Gates Consulting Engineers. Inc. in the amount of Four Hundred Thirty Eight Thousand
Four Hundred Eighty Three Dollars ($438,483.00) for engineering services related to
waterline replacement; and
WHEREAS, the Consultant has requested authorization in the amount not to
exceed $45,000 to perform additional services for the water system improvement project
in order to obtain a Nationwide Permit(s) or an individual permit from the United States
Army Corps of Engineers as it pertains to wetlands; and
WHEREAS, the Consultant has provided a Letter of Request for said additional
services dated April 2, 2003 and attached as Exhibit "A", outlining the proposed cost of
additional services of up to $45,000; and
WHEREAS, the Director of Utility Operations and the Assistant Director of Utility
Operations have reviewed said request with the project consultant and concur with the
need for the additional services.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Manager of the City of Port Arthur be and is hereby
authorized and directed to approve the additional services for the wetlands study and
permit acquisition in the amount not to exceed $45.000 and are authorized to execute the
proposal attached hereto as Exhibit "A".
Section 3. That a copy of the caption of this Resolution be spread upon the
Minutes of the City Council.

ADDITIONAL ENVIRONMENTAL SERVICES
IN CONNECTION WITH WATER LINE REHABILITATION PROJECT

Dear Mr. Shepherd:
We recently met to discuss the need to provide additional services under the terms of
our contract with the City for the water system improvement project. In particular, the
additiona services will be required in order to obtain a Nationwide Permit(s) from the
US Army Corps of Engineers (USACE) for the construction of certain segments of the
proposed water system totaling 16,000 feet and located along State Highway 87 near
the Gulf Intracoastal Waterway.
The proposed additional services consist of conducting a wetland delineation study,
survey and mapping, and preparation of documentation required by the USACE in
order to obtain a Nationwide Permit for the utility construction. All work will be
conducted in accordance with the methods described in the Wetland Delineation
Manual. The scope of additional services is described below:
SCOPE OF ADDITIONAL SERVICES
Review previously published soil data published by the U.S. Department
of Agriculture, Natural Resource Conservation Service, to determine the
types of surface soils expected to be confirmed by on-site soil analysis.
Review historical aerial color and black/white photographic enlargements
for selected years. Infrared color photographs will be analyzed for the
presence of wetland signature color distortions. Information for all
photographic interpretation will be compared to locate recurring sites
where wetland signatures are present.

Inspect the property under the field procedures outlined in the 1987
Manual for Wetland Determination by the U.S. Army Corps of Engineers.
Transects will be performed across the property, perpendicular to the
nearest watercourse. Samples of vegetation, soils, and hydrology
indicators will be taken at each change in topography or vegetation.
Vegetation samples will be evaluated ant recorded at each sample area.
Upland vegetation will be verified, I:or it is as significant as wetland
vegetation in the determination process, nspection of the property for
evidence or lack of wetland hydrology will De performed at each sample
area. Soil samples will be evaluated at each test site for their hydric and
non-hydric characteristics. Non-hydric soils verify upland status and are
as significant as hydric soils in the determination process. As many as
50+ sample sites, evaluating vegetation, soil, and hydrology criteria, may
be necessary.
Upon completion of the site reconnaissance and in-office analysis of the
stucly data. the boundaries of the area determined to be Jurisdictional
Waters of the United States will be plotted on a scaled map. We will flag
the jurisdictional wetland areas and the ordinary high water mark.
Prepare a scaled map to show wetland areas, wetland type, and the limits
of Jurisdictional Waters. Based upon field data collected and cross-
section measurements, taken while performing site reconnaissance, each
Jurisdictional area will be depicted with the following information: (1) size
and shape; (2) surface area calculation (acres); and (3) combined total
wetland and Jurisdictional Water area calculations for the entire subject
tract.
Prepare a final report. The report will include a discussion of methodology
used to delineate the tract, site findings, copies of all historical information
reviewed such as USGS topographical maps, NRCS soil survey maps,
aerial photographs, site photographs, USACE routine data sheets, and a
wetland delineation mao.
Jurisdictional Wetland areas encountered within the proposed area will be
assessed to determine the type of Section 404 permit that will be required.
We will then prepare, based upon the above findings, the appropriate
Section 404 Nationwide and 401 Permit, along with the required
conceptual mitigation plan, Threatened and Endangered Species survey,
archeological review and alternative analysis, for submittal to the Corps of

Engineers for approval consideration. We will also attend two (2)
meetings with the regulatory agencies including site verification with the
USACE, during the permit approval process.
SCHEDULE
The schedule for completion is estimated at 60-90 days. The project completion
schedule is the goal of all parties but does not reflect unusual delays due to major,
unpredictable or unforeseen delays, modifications to the scope of work based upon
actual findings, or upon additional requests by governmental review.
COMPENSATION
We propose to be compensated on the basis of rates established in our Contract for
Professional Services in an amount not exceeding Twenty-four Thousand Nine
Hundred Dollars ($24,900.00). If however, the USACE requires an individual permit,
the additional work required for that service will require a budget increase to Forty-five
Thousand Dollars ($45,000.00)
If this Proposal meets with your approval, please indicate your acceptance in the
spaces provided below. We will consider this acceptance as our authority to begin work
for preparing a Nationwide Permit and will do so within five (5) working days.
