Fitzgibbons, City Manager Date: April 16, 2003 Subject: Council Action Memorandum on Proposed Resolution No. 12156 Appointing a Negotiating Team to Conduct Collective Bargaining With the Port Arthur Police Association, Inc. Comment Recommendation: I recommend that the City Council adopt Proposed Resolution No. 12156, which appoints a negotiating team to conduct collective bargaining with Port Arthur Police Association representatives for the fiscal year begktming October 1, 2003. Background: The City received written notice fi~m the Port Arthur Police Association, Inc. of their intent to engage in collective bargaining regarding monetary and non-monetary items for the fiscal year beginning October 1, 2003. Currently, we are operating under a three year contract covering the period October 1, 2000 through September 30, 2003. Written notice of their intent to bargain ~vas received on January 13, ,2003 (copy attached). Budgetary_ / Fiscal Effect: None. Employee / StaffImpact: None. Summary_: I recommend that thc City Council adopt Proposed Resolution No. 12156, which appoints a negotiating team to conduct collective bargaining with representatives of the Port Arthur Police Association. Box 1089 Port Arthur, Tx. 77641 January 13, 2003 Dear Manager: The Port:Arthur Police Association represents a majority of the affected employees of the Port Arthur Police Department for the p ,urpose of collective bargaining. Please accept this letter as notice of intent for the Port Arthur Police Association to commence collective bargaining negotiations with the City of Port Arthur, Texas for the fiscal year beginning October 1, 2003. This written notice is given pursuant to the provisions of the Texas Local Government Code, Chapter 174 Section 174.107 (The Fire & Police Employees Relations Act). Our Association Representatives would be pleased to meet with you in an informal setting to discuss proposals. NO. 12156 04/16/03 - SFB A RESOLUTTON APPOINTI'NG A NEGOTI'ATTNG TEAH UNDER CHAPTER 174 OF THE TEXAS LOCAL GOVERNHENT CODE ANNOTATED; TO CONDUCT COLLECTIVE BARGAI'NTNG WI'I'H THE BARGATNI~NG AGENT OF THE PORT ARTHUR POLTCE ASSOCI'ATI'ON OF THE CI~TY OF PORT ARTHUR POLI'CE DEPARTMENT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, pursuant to Chapter 174 of the' Texas Local Government Code Annotated, the following persons are hereby designated to conduct collective bargaining on behalf of the City with representatives of the Port Arthur Police Association, the bargaining agent of the Police Officers of the City of Port Arthur Police Department: City Manager, Director of Human Resources, Assistant Director of Human Resources, Director of Finance and City Attorney; and, THAT, the City Manager is hereby authorized to designate a chief spokesperson; and, THAT, the City Manager is also hereby authorized to provide a suitable place for the collective bargaining sessions, and to provide such supporting City personnel as needed by the City negotiating team, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
